For the purpose of protection of the rights and legitimate interests of consumers of realtor services, strengthening of the legal basis of realtor activities:
1. Determine that:
1.1. The Ministry of Justice realizes state policy in the field of realtor activities in the Republic of Belarus, and also exercises regulation, control and control in this sphere according to this Decree;
1.2. realtor activities in the Republic of Belarus are performed by the commercial organizations, including state, in the presence of the license for implementation of realtor activities provided by the Ministry of Justice (further - the license) if other is not provided by this Decree.
The territorial organizations for state registration of real estate, the rights to it and transactions with it have the right to perform realtor activities without license according to the procedure, established by this Decree;
1.3. realtor activities in the Republic of Belarus are intermediary activities of the commercial organization for assistance in case of the conclusion, execution, the termination of construction agreements (including equity), purchase and sale, exchange, lease, other transactions with real estate objects, the rights to them (except for the organizations and holding auctions and tenders), including:
consulting services in transactions with real estate objects;
submission of information on the demand and supply on real estate objects;
matching of versions of the transaction with real estate object, transactions with participation in real estate asset construction;
organization and carrying out approval of conditions of the forthcoming transaction;
the help in preparation (registration) of the documents connected with implementation of the transaction with real estate object, transactions with participation in asset construction of the real estate, registration of real estate, the rights to it and transactions with it.
