About modification of some legal acts of the Kyrgyz Republic (The code of the Kyrgyz Republic about the non-tax income, the Law of the Kyrgyz Republic "About production wastes and consumption")

Article 1.

Bring in the Code of the Kyrgyz Republic about the non-tax income (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2018, Art. No. 7-8, 490) the following changes:

The Code to add 1) with Chapter 27-1 of the following content:

"Chapter 27-1. Utilization charges

Article 84-1. Payer

Collection for conversion of mercury-containing waste (utilization collection) is paid by producers, importers of the mercury-containing products which are subject to conversion after loss of consumer properties by them.

Article 84-2. Size and payment procedure

1. The size, procedure and terms of introduction of utilization collection for conversion of mercury-containing waste are established by the Government of the Kyrgyz Republic.

2. The producer, the importer of mercury-containing products includes utilization collection in product cost.

3. The means which arrived in the republican budget on account of payment of utilization collection are spent by means of implementation of state programs of the Kyrgyz Republic in the form of provision of subsidies to the organizations for conversion of mercury-containing waste for joint financing of the works approved in accordance with the established procedure for covering of expenses on collection, transportation, conversion of waste from use of mercury-containing products.";

Article 153 to add 2) with Item 35-1 of the following content:

"35-1) utilization charges;".

Article 2.

Bring in the Law of the Kyrgyz Republic "About production wastes and consumption" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2001, No. 10, the Art. 370) the following changes:
