About introduction of amendments to the Law on the government employee with special status of the Ministry of Internal Affairs No. 288/2016

The Parliament adopts this organic law.

Art. I. - In the Law on the government employee with special status of the Ministry of Internal Affairs No. 288/2016 (Official monitor of the Republic of Moldova, 2017, Art. No. 40-49, 85), with subsequent changes, to make the following changes:

1. Add the law with Article 12-1 of the following content:

"Article 12-1. Access to position in connection with change of category of position

(1) the Government employee with special status which position is transferred from category of the officer case to category of the subofficer case in connection with reducing positions has the right to hold new position with preserving special officer rank, the rights and guarantees which are saved up earlier including the salary.

(2) Assignment of the following special rank up to special rank of the leading inspector inclusive to person designated based on part provisions (1), it is performed with observance of this law, except for conditions, stipulated in Item b) parts (3) Article 21.

(3) If the government employee with special status holding position according to the provisions provided by part (1), holds afterwards position from category of the officer case, the rights and guarantees corresponding to new position are provided to it.

(4) the Procedure for transfer of government employees with special status from category of the officer case in category of the subofficer case in connection with reducing positions as a result of change of category of positions is regulated by the Government.".

2. In Article 38:

in Item m) parts (words", including in case of the expiration of limitation period," to exclude 1);

in part (3) the text "i)," to exclude.

Art. II. - To the government in six-months time from the date of publication of this law in the Official monitor of the Republic of Moldova to bring the regulations into accord with it.
