About modification of some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 15, of 55, 56 Laws of Ukraine "About the National Bank of Ukraine", to Articles 4, of 66, 67 Laws of Ukraine "About banks and banking activity", for the purpose of enhancement of regulation of activities of banks of Ukraine the Board of the National Bank of Ukraine DECIDES:

1. In the Section X of the Instruction on procedure for regulation of activities of banks in Ukraine approved by the resolution of Board of the National Bank of Ukraine of August 28, 2001 No. 368, of Ukraine registered in the Ministry of Justice on September 26, 2001 for No. 841/6032 (with changes) (further - the Instruction No. 368):

Item 2 to add 1) with the new paragraph of such content:

"The requirement of paragraphs of the first, fifth Item 2 of the Section X of this Instruction does not extend to the active transactions performed under agreements which are signed about day of receipt of the status by bank systemically important (except agreements in which the unconditional right of bank unilaterally is determined to refuse further accomplishment of the undertaken obligations) provided that after day of acquisition by bank of the status systemically important changes concerning increase in the amount and/or term and/or change of condition of the obligation on crediting with revocable for irrevocable were not made to such agreements.";
