About modification of article 12 of the Law on state security No. 618/1995

The Parliament adopts this organic law.

Art. I. - In article 12 of the Law on state security No. 618/1995 (Official monitor of the Republic of Moldova, 1997, Art. No. 10-11, 117), with subsequent changes, to make the following changes:

part (to state 5) in the following edition:

"(5) For the purpose of implementation of decisions of the Supreme council of safety his members publish the orders which are not going beyond constitutional and the warrants of law caused by the position held by them.";

add Article with part (5-1) following contents:

"(5-1) V departure from part provisions (5) the National Bank of Moldova applies decisions of the Supreme council of safety in part in what they do not mention its status and autonomy established by the law.";

part (to state 6) in the following edition:

"(6) the citizen of the Republic of Moldova having the higher education, not having criminal record, having faultless reputation and not being the member of any batch can be appointed the Secretary of the Supreme council of safety.";

add Article with parts (7) - (9) the following content:

"(The Central bodies of the public power, and also bodies and their competences falling within the scope subordinated to the Government organizational structures, including in what the central administrative authority acts as the founder (the company, organization and the organization irrespective of property type), and equally independent public legal entities shall provide 7) on demand or on own initiative any supplied and the information including which is the state, bank or trade secret which concerns homeland security, defense and public order, and also other information for the purpose of its use for preparation of decisions of the Supreme council of safety.

(8) Refusal specified in part (7) bodies to provide the information requested by the Supreme council of safety attracts the responsibility provided by the law.
