About introduction of amendments to the Law of the Kyrgyz Republic "About the status of legal executives and about enforcement proceeding"

Article 1.

Bring in the Law of the Kyrgyz Republic "About the status of legal executives and about enforcement proceeding" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2017, No. 1 (2), the Art. 15) the following changes:

Part 1 of Article 12 to add 1) with Item 15-1 of the following content:

"Article 93-1. Database of debtors on maintenance obligations

1. The authorized state body creates and conducts, including in electronic form, the database containing the information about debtors according to maintenance obligations.

2. The procedure for forming and maintaining the database is determined by the Chief bailiff.

3. The following data containing in the database are public:

1) type of the executive document, its number, the name of the body which issued the executive document;

2) acceptance date of the executive document;

3) number of enforcement proceeding;

4) data on the debtor (surname, name, middle name, birth date, birthplace, photo);

5) the amount of outstanding debt according to the executive document;

6) the name and the address of division of service of legal executives in which the enforcement proceeding is conducted;

7) data on the announcement of search of the debtor.

4. The data specified in part 3 of this Article are published in case of finding of the debtor in search based on the written application of the claimant and are public before the end of debt repayment or the termination of enforcement proceeding; these data are posted on the official site of authorized state body.
