About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of November 29, 2018 No. 307 "About approval of Rules of implementation of activities of the central depositary"
For the purpose of enhancement of regulatory legal acts of the Republic of Kazakhstan the Board of National Bank of the Republic of Kazakhstan DECIDES:
1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of November 29, 2018 No. 307 "About approval of Rules of implementation of activities of the central depositary" (it is registered in the Register of state registration of regulatory legal acts at No. 17920, it is published on December 20, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes and amendments:
in the Rules of implementation of activities of the central depositary approved by the specified resolution:
add with Item 6-1 of the following content:
"6-1. The list of shareholders for implementation of payment by results of the transaction realized according to article 25-1 of the Law of the Republic of Kazakhstan of May 13, 2003 "About joint-stock companies" (further - the Join-stock companies law), is constituted according to the set of rules of the central depositary.
The data specified in part one of this Item are represented by the central depositary to joint-stock company (further - society) to which person specified in Item 1 of Article 25-1 of the Join-stock companies law addressed (further - the large shareholder), before implementation of the transaction on sale by shareholders of the stocks of society owned by them upon the demand of the large shareholder according to Article 25-1 of the Join-stock companies law.";
add with Item 12-1 of the following content:
"12-1. Within activities for the organization of the securities trading and other financial instruments the central depositary performs the following functions:
1) operation and maintenance of the integrated information system of the over-the-counter market;
