Article 1

Bring in the Federal Law of November 11, 2003 No. 152-FZ "About mortgage securities" (The Russian Federation Code, 2003, No. 46, Art. 4448; 2005, No. 1, Art. 19; 2006, No. 31, Art. 3440; 2010, No. 11, Art. 1171; 2012, No. 53, Art. 7606; 2013, No. 30, Art. 4084; No. 51, Art. 6699; 2016, No. 1, Art. 81; No. 27, Art. 4294; 2017, No. 27, Art. 3938; No. 48, Art. 7052; 2018, No. 53, Art. 8440; 2019, No. 18, Art. 2200) following changes:

The paragraph the fifth articles 2 after words "provided with mortgage" to add 1) with the words "and (or) pledge of the rights to claim of the participant of shared-equity construction following from the agreement of the participation in shared-equity construction meeting the requirements of the Federal Law of December 30, 2004 No. 214-FZ " about participation in shared-equity construction of apartment houses and other real estate objects and about modification of some legal acts of the Russian Federation " (further-rights to claim of the participant of shared-equity construction)";

2) in Article 3:

a) 1 after the words "provided with mortgage" to add part with the words "and (or) pledge of rights to claim of the participant of shared-equity construction";

b) add with part 3.1 following of content:

"3.1. Requirements on secure pledge of rights to claim of the participant of shared-equity construction to obligations can be part of mortgage covering only in case of their compliance to the following conditions:

the agreement of participation in shared-equity construction is signed according to requirements of the Federal Law of December 30, 2004 No. 214-FZ "About participation in shared-equity construction of apartment houses and other real estate objects and about modification of some legal acts of the Russian Federation";
