About entering of amendments and changes into the Water code of the Republic of Armenia

Article 1. Article 30.1 of the Water code of the Republic of Armenia of June 4, 2002 (further - the Code) to add with parts 3-4 following of content:

"Except the bases for variation established by part of 1 of this Code, requests for permission to water use for again under construction small hydroelectric power stations are also rejected if:

1) the construction of small power plants is provided on the rivers:

and. in which there are places of laying of caviar of the local species of fish registered in the Red List of the Republic of Armenia or characteristic of the territory;

. which embarrassment derivational pipes makes 40 percent and more;

century on which there are water measuring observation posts and marks of the planned water intake or water disposal bypass water measuring observation posts;

2) the construction of small hydroelectric power stations is performed:

and. in the central areas and zones of direct impact of the Lake Sevan;

. in zones of protection of especially protected natural territories;

century on adjacent to natural monuments the territories in radius of 150 meters;

in zones of protection of water ecosystems;

in the territories of forming of current of the rivers;

e. on sections of the rivers where there are landslide territories;

. on forest lands or the territories where for construction of roads, bringing to the construction territory, there is need of cutting down of trees, except as specified availability of consent to implementation of works on the state forest lands, stipulated in Article 20 Forests codes of the Republic of Armenia.

The list of the rivers provided by subitems "an" and "b" of Item 1 of part 2 of this Article establishes the Government.

The landslide territories provided by the subitem "d" of Item 2 of part 2 of this Article are established by the Government.".
