About change of the resolution of the State Customs Committee of the Republic of Belarus of April 26, 2012 No. 11

Based on Item 7 of Article 64, Items 1 and 5 of Article 135, Item 6 of Article 149, parts two of Item 2 of article 244 of the Law of the Republic of Belarus of January 10, 2014 No. 129-Z "About customs regulation in the Republic of Belarus", parts two of Item 2 of article 119 of the Tax Code of the Republic of Belarus, paragraphs of third and fifth Item 27 of the Regulations on the free customs zones created in the territories free (special, special) economic zones, No. approved by the Presidential decree of the Republic of Belarus of January 31, 2006 66, parts two of subitem 42.7 of Item 42 of the Regulations on free warehouses approved by the Presidential decree of the Republic of Belarus of February 9, 2012 No. 55, of part two of Item 3 of the Regulations on duty-free shops No. approved by the Presidential decree of the Republic of Belarus of April 22, 2014 175, parts nine of Item 27 of appendix 1 to the Presidential decree of the Republic of Belarus of December 22, 2018 No. 490 "About customs regulation", paragraph two of part one and part two of Item 6, paragraph two of part two and paragraph two of part three of Item 9, paragraph two of part two and paragraph two of part three of Item 11, paragraph two of part three and paragraph two of part four of Item 12, subitem 17.1 of Item 17, paragraph two of part one of Item 19 of the Regulations on completion of action of customs procedure of free customs zone (free warehouse) approved by the resolution of Council of Ministers of the Republic of Belarus of March 21, 2014 No. 241, of subitem 10.7 of Item 10 of the Regulations on the State Customs Committee of the Republic of Belarus No. approved by the Presidential decree of the Republic of Belarus of April 21, 2008 228, the State Customs Committee of the Republic of Belarus DECIDES:

1. Bring in the resolution of the State Customs Committee of the Republic of Belarus of April 26, 2012 No. 11 "About procedure for accounting and submission of the reporting for the purposes of customs control" the following changes:

1.1. state the name in the following edition:

1.3. in Item 1:

state subitem 1.1 in the following edition:

"1.1. the customs representative submits in the Minsk central customs the report on committed customs transactions on form according to appendix 1;";

to exclude from subitem 1.2 of the word "to this resolution";

in subitem 1.3:

exclude the words "to this resolution";

add the subitem with part of the following content:

"The owner of duty-free shop records the goods realized on boards of aircrafts of the Belarusian aviation organizations performing the international airborne transportations of passengers and represents to customs in which region of activities the duty-free shop, the report on such goods on declaration form on goods is located;";

about consumption of goods according to appendix No. 1 to the Decision of Council of the Eurasian economic commission of December 20, 2017 No. 88 "About some questions of application of customs procedure of free customs zone" (further - the report on consumption of goods).";

1.4. state Item 2 in the following edition:

"2. Approve the Instruction about procedure for submission to customs authorities of reports it (is applied).";

1.5. to be reworded as follows appendices 1 and 2 to this resolution (are applied);

1.6. in appendix 3 to this resolution:

After registration of the report on MBT or the report on sales of goods on boards to the owner of duty-free shop who submitted the report the electronic message containing information on registration number of such report on the following structure goes:

where TT - the code of customs performing registration of the report on MBT or the report on sales of goods on boards according to the qualifier of customs authorities and Items of customs clearance established in appendix 2 to the resolution of the State Customs Committee of the Republic of Belarus of May 30, 2014 No. 30 "About Items of customs clearance" (further - the qualifier);

PPP - code of Item of customs clearance where registration of the report on MBT or the report on sales of goods on boards, according to the qualifier is performed;

DD - day of registration of the report on MBT or the report on sales of goods on boards;

MM - month of registration of the report on MBT or the report on sales of goods on boards;

One or two the last figures of year of registration of the report on MBT or the report on sales of goods on boards;

Р - alphabetic code:

"About" - in case of registration of the report on MBT;

"B" - in case of registration of the report on sales of goods on boards;

НННННН - sequence number of registration of the report on MBT or the report on sales of goods on boards which has end-to-end numbering within year and begins with number 000001.

After adoption of the report on MBT or the report on sales of goods on boards to the owner of duty-free shop who submitted the report the electronic message containing information on the registration number of adoption of such report assigned on the following structure goes:

TTPPP/GHNNNNNN,

where TT - the code of customs performing registration of adoption of the report on MBT or the report on sales of goods on boards according to the qualifier;

PPP - code of Item of customs clearance where registration of adoption of the report on MBT or the report on sales of goods on boards, according to the qualifier is performed;

- the last figure of year of registration of the report on MBT or the report on sales of goods on boards;

X - alphabetic code:

"About" - in case of registration of adoption of the report on MBT;

"B" - in case of registration of adoption of the report on realization on boards;

НННННН - sequence number of registration of adoption of the report on MBT or the report on sales of goods on boards which has end-to-end numbering within year and begins with number 000001.";

in Item 7:

the paragraph one to state in the following edition:

"7. The report on MBT and the report on sales of goods on boards are filled in according to the Instruction about procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257, taking into account the following features:";

In case of modification according to part one of this Item the owner of duty-free shop represents according to the procedure, determined by Item 6 of this Instruction, the report with indication of the data which did not undergo changes, and also the changed data (further - the adjusting report). At the same time in column 44 of the adjusting report under the 10021 code registration number of the prior report to which changes are made is specified.

Registration of the submitted adjusting report is performed by customs authorities according to the procedure, stipulated in Item the 6th this Instruction.

Submission of the adjusting report by the owner of duty-free shop can be performed before the expiration of the accounting period following the period to which it is supposed to make changes.";

in the paragraph the second Item 8 of the word "placed in the territory of the customs control zone" shall be replaced with words "placed in the customs control zone";

the thirteenth to exclude the paragraph;

the fifteenth to add the paragraph with words ", without net weight of the goods corresponding to the number of irretrievable lost production losses specified in column 17";

the sixteenth to state the paragraph in the following edition:

"in column 17 the goods quantity corresponding to the number of irretrievable lost production losses in kilograms is specified. If goods quantity, placed under customs procedure of conversion on customs area (conversions for internal consumption), in the part corresponding to the number of irretrievable lost production losses it is impossible to specify in kilograms, their quantity is specified in additional units of measure according to which goods were placed under customs procedure of conversion on customs area (conversions for internal consumption), specified in column 14;";

in column 16 the net weight of the goods specified in column 13 is specified;

column 17 is not filled in;

in column 21 the country code of the goods origin specified in the column 11, according to the qualifier of the countries of the world is specified;

in column 22 on each commodity code specified in the column 7, the size of ad valorem share of customs value (as a percentage) calculated as follows is specified: ratio of the amount of the customs value specified in column 10 and increased on 100, rounded by mathematical rules to entire quantity.";

2. This resolution becomes effective since December 30, 2019.
