Changes which are made to acts of the Government of the Russian Federation

1. In the order of the Government of the Russian Federation of August 14, 1992 No. 587 "Questions of private detective (detective) and private security activities" (Collection of acts of the President and the Government of the Russian Federation, 1992, No. 8, Art. 506; Russian Federation Code, 2017, No. 31, Art. 4939):

a) the second offer of Item 2 of appendix No. 8 to the specified resolution to add with the words "in coordination with the Federal Service of troops of national guard of the Russian Federation";

b) to state Item 5 of appendix No. 9 to the specified resolution in the following edition:

"5. The conclusion about impossibility of the admission of the citizen of the Russian Federation in connection with the increased danger of violation of the rights and freedoms of citizens, emergence of threat of public safety and the conclusion about impossibility of the admission of the citizen of the Russian Federation to implementation of private detective (detective) activities in connection with the increased danger of violation of the rights and freedoms of citizens, emergence of threat of public safety are prepared for implementation of private security activities by territorial authority of the Federal Service of troops of national guard of the Russian Federation in time, not exceeding 20 days from the date of giving by the citizen of the Russian Federation the statement for provision to it certificates of the private security guard, the license for implementation of private detective (detective) activities, in the presence of the bases specified in item 4 of these rules on the basis of results of check, the Federal Security Service which is carried out by law-enforcement bodies and (or) bodies in accordance with the legislation of the Russian Federation at the request of territorial authority of the Federal Service of troops of national guard of the Russian Federation, also affirm authorized officers of territorial authority of the Federal Service of troops of national guard of the Russian Federation.".

2. In the order of the Government of the Russian Federation of June 23, 2011 No. 498 "About some questions of implementation of private detective (detective) and private security activities" (The Russian Federation Code, 2011, No. 26, Art. 3820; 2015, No. 38, Art. 5278; 2018, No. 27, Art. 4082):

a) in Item 2 of the word "To the Ministry of Internal Affairs of the Russian Federation and" to exclude;

b) in Regulations on the licensing of private detective (detective) activities approved by the specified resolution:

in Item 2:

word in paragraph one "law-enforcement bodies, authorized on implementation of actions for licensing in this field of activity (further - licensing authorities)" shall be replaced with words "The Federal Service of troops of national guard of the Russian Federation, authorized in the field of private security activities, or its territorial authority (further - the licensing body)";

word in paragraph three "The Ministry of Internal Affairs of the Russian Federation" shall be replaced with words "The Federal Service of troops of national guard of the Russian Federation";

state Item 3 in the following edition:

"3. The licensed requirements imposed to the license applicant in case of intention to perform the licensed type of activity, and also to the licensee when implementing of the licensed type of activity are:

a) observance by the license applicant (licensee) of requirements and restrictions, the stipulated in Clause 6 Laws of the Russian Federation "About private detective and security activities in the Russian Federation";

b) accomplishment by the licensee of requirements to actions of the private detective, the stipulated in Article 5 Laws of the Russian Federation "About private detective and security activities in the Russian Federation";

c) observance by the licensee of restrictions in the field of activities of the private detective, the stipulated in Article 7 Laws of the Russian Federation "About private detective and security activities in the Russian Federation";

d) availability at the licensee of the contract for rendering detective services with each customer constituted in writing, conforming to requirements of article 9 of the Law of the Russian Federation "About private detective and security activities in the Russian Federation";

e) the notification the licensee in writing about the conclusion of the service provision contract, stipulated in Item 7 parts two of article 3 of the Law of the Russian Federation "About private detective and security activities in the Russian Federation", person making inquiry, the investigator or court in which production there is criminal case, within a day from the moment of its conclusion.";

add with Item 3 (1) the following content:

"3(1). Gross violations of licensed requirements when implementing private detective (detective) activities are violations of the licensed requirements provided by subitems "an" - "in" Item 3 this provision who entailed the effects provided by part 11 of article 19 of the Federal law "About Licensing of Separate Types of Activity".";
