About modification of some legal acts

The Parliament adopts this organic law.

Art. I. – In the Law on control over tobacco No. 278/2007 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 258-261, 489), with subsequent changes to make the following changes:

1. In Article 2:

after the concept "additive" to add Article with concept of the following content:

"aerosol of tobacco product or similar product – the substances emitted as a result of inclusion and by means of use of the device for heating of the not smoking tobacco product or similar product which is not assuming process of burning or decay, or any other new tobacco product which otherwise is included for use;";

state the concept "smoking" of the following edition:

"smoking – possession or manipulation of the lit or smoldering smoking tobacco product or similar product assuming process of burning or decay irrespective of, smoke actively is inhaled or exhausts. For the purposes of this law possession or manipulation of the device which is switched on for heating of the not smoking tobacco product or similar product which is not assuming process of burning or decay or any other new tobacco product which is not assuming process of burning or decay irrespective of, the aerosol actively is inhaled or exhausts is recognized smoking;";

in the concept "tobacco smoke" "smoking" to exclude the word;

after the concept "cross-border advertizing, promotion and sponsorship of tobacco products" to add Article with concept of the following content:

"tobacco стик – not smoking tobacco product, held for use by means of the device for heating of tobacco and other substances for the purpose of allocation of aerosol for inhalation and not assuming burning process;".

2. Ceased to be valid according to the Law of the Republic of Moldova of 19.12.2019 No. 170.
