About approval of Aviation rules of state registration of experimental aircrafts of the Republic of Belarus

1. Approve the enclosed Aviation rules of state registration of experimental aircrafts of the Republic of Belarus.
2. Declare invalid the resolution of the State military-industrial committee of the Republic of Belarus of October 23, 2015 No. 4 "About approval of Aviation rules of state registration of experimental aircrafts of the Republic of Belarus".
3. This resolution becomes effective after its official publication.

1. These Aviation rules developed according to the Air code of the Republic of Belarus (further - the Air code) and based on the Presidential decree of the Republic of Belarus of April 13, 2015 No. 164 "About modification and amendments in the Presidential decree of the Republic of Belarus", resolutions of Council of Ministers of the Republic of Belarus of July 9, 2015 No. 581 "About measures for implementation of the Presidential decree of the Republic of Belarus of April 13, 2015 No. 164" and of August 6, 2015 No. 665 "About approval procedure of the aviation rules regulating activities in the field of experimental aircraft, and the list of positions of aviation personnel of experimental aircraft of the Republic of Belarus" govern the relations in the part concerning the organization of state registration of experimental aircrafts of the Republic of Belarus, their exception of the State register of experimental aircrafts of the Republic of Belarus registrations and issues of registration certificates and certificates on exception, are determined requirements to coloring of experimental aircrafts, assignment of the state and registration signs by it, and also to drawing on them signs, numbers and other symbols, texts and emblems.
2. Action of these Aviation rules extends to all legal entities in whose activities the experimental aircraft of the Republic of Belarus is used (further - experimental aircraft).
3. For the purposes of these Aviation rules the following main terms and their determinations are applied:
the owner of the experimental aircraft (further - AF) - the legal entity performing development, production, upgrade, testing, operation or other actions concerning the experimental AF belonging to it on the property right, the right of economic maintaining or operational management or other bases, stipulated by the legislation or the agreement;
The state register of experimental aircrafts of the Republic of Belarus (further - the State register) - the document (the special magazine) in which registration of experimental AF of the Republic of Belarus is made;
the applicant - the legal entity who filed petition in the State military-industrial committee of the Republic of Belarus (further - Goskomvoyenprom);
modification - any main thing, the minor acoustic or issued change of standard design of object of aircraft affecting its characteristics (for AF - the flight validity) influencing the environment;
identification marks - the state, registration and identification marks, board numbers and symbols, texts and emblems applied on AF;
the registration certificate - the document certifying entering of experimental AF into the State register;
structural division - the division of Goskomvoyenprom performing function of specially authorized body in the field of experimental aircraft.
Other concepts applied in these Aviation rules are used in the values specified in the Air code and aviation rules regulating activities in the field of experimental aircraft.
4. Prior to carrying out flight testing of AF is subject to obligatory registration in the State register.
5. Registration of AF, registration and issue of necessary with respect thereto documents are carried out by structural division. The amount of payment of the ministerial procedure levied when implementing is established by the acts of the legislation regulating implementation of ministerial procedures in the Republic of Belarus.
6. State registration in the State register of experimental aircrafts of the Republic of Belarus (further - registration) are subject to AF of experimental aircraft.
7. The state fee in the sizes established by legal acts of the Republic of Belarus is paid for registration of experimental AF.
8. AF before submission of documents on registration in the State register by the owner assigns board number.
The procedure for assignment of board number to experimental AF is determined by the head of the organization (the owner of experimental AF) in whose activities the experimental aircraft is used.
9. Before registration of AF it shall be excluded from other state registers, and also from registers of AF of other states.
10. Registration of AF of experimental aircraft in the State register is carried out based on the documents submitted to Goskomvoyenprom according to acts of the legislation of the Republic of Belarus of ministerial procedures.
