About modification of some legal acts of Ukraine concerning ensuring efficiency of the institutional mechanism of prevention of corruption

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Verkhovna Rada of the Ukrainian SSR, 1984, appendix to No. 51, the Art. 1122):

Shall be replaced with words 1) in part one of Article 212-3 of the word "About the Principles of Prevention and Anti-corruption" "About prevention of corruption";

2) in Item of 1 part one of Article 255:

a) in the paragraph the second "172-4 - 172-9" to replace figures with figures and the words "172-4 - 172-9 (except for the offenses made by officials who hold responsible and especially responsible position), 172-9-1";

b) the paragraph "The national agency concerning prevention of corruption (Article 172-4 - 172-9, 172-9-2, 188-46, 212-15, 212-21)" Item of 1 part one to state in the following edition:

"The national agency concerning prevention of corruption (Article 172-4 - 172-9 (regarding the offenses made by officials who hold responsible and especially responsible position), 188-46, 212-15, 212-21);

Note. Officials who hold responsible and especially responsible position in this Article are understood as persons specified in the note to article 50 of the Law of Ukraine "About prevention of corruption";

3) in Article 257:

a) the second to state part in the following edition:

"The protocol on making of the administrative offense connected with corruption together with other materials in three-day time from the moment of its creation goes to local general court in the place of making of such offense";

b) in part three of the word "making of corruption offense" shall be replaced with words "making of the administrative offense connected with corruption";

c) in part four:

shall be replaced with words the words "about making of administrative corruption offense" "about making of the administrative offense connected with corruption";

after the words "notification on creation of the protocol" to add with the words "for consideration of question of rather possible discharge of such person from accomplishment of office powers";

Shall be replaced with words 4) in part four of Article 277 of the word "administrative corruption offenses" "and the administrative offenses connected with corruption", and the words "protocol on administrative corruption offense" shall be replaced with words "the protocol on such offense";

Shall be replaced with words 5) in part seven of Article 285 of the word "for administrative corruption offense" "for the administrative offense connected with corruption".

2. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

The note to article 45 after figures "365-2" to add 1) with figures "366-1";

In paragraph one of part one of Article 172 of the word of "the Law of Ukraine "On bases of prevention and anti-corruption" shall be replaced with words 2) "the Law of Ukraine "On prevention of corruption".

3. In the Criminal Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88):

3) in Article 216:

a) "The chairman of the National Bank of Ukraine, his first deputy and the deputy" to add Item of 1 part four after words with words "The chairman of the National agency concerning prevention of corruption, his deputy";

b) "The chairman of the National Bank of Ukraine, his first deputy and the deputy" to add paragraph two of Item of 1 part five after words with words "The chairman of the National agency concerning prevention of corruption, his deputy";

Item 10 parts one of Article 480 to state 4) in the following edition:

"10) the Chairman of the National agency concerning prevention of corruption, his deputy";

2 parts one of Article 481 of the word "to the member of the National agency concerning prevention of corruption - the Attorney-General (the acting as the Attorney-General)" shall be replaced with words 5) in Item "To the chairman of the National agency concerning prevention of corruption, to his deputy - the Attorney-General (the acting as the Attorney-General) or the deputy attorney general - the head of Specialized anti-corruption prosecutor's office".

4. In article 8 of the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383; 2009, No. 13, Art. 161; 2013, No. 21, Art. 208; 2014, No. 20-21, of Art. 712; 2016, No. 30, Art. 542):

the eighth to add part with words "To the national agency concerning prevention of corruption on its written request performed for the purpose of accomplishment of the powers determined by the Law of Ukraine "About prevention of corruption";

the thirteenth after words of "the private contractor" to add part with words of "The national agency concerning prevention of corruption".

5. In the Law of Ukraine "About political parties in Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2001, No. 23, Art. 118; 2015, Art. No. 49-50, 449):

1) in Article 17-2 of the word "the two 100-th the size" shall be replaced with words "one 100-th sizes";

2) in parts one of Article 17-3 of the word and figure "at least 2 percent" shall be replaced with words also in figure "at least 5 percent".

6. In the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 2, Art. 17; 2017, No. 2, Art. 25):

Part the seventh articles 11 after paragraph one to add 1) with the new paragraph of such content:

"Also direct automated access to the Unified state register is provided to the national agency concerning prevention of corruption".

With respect thereto to consider paragraph two the paragraph third;

2) in Article 30:

state the name in the following edition:

"Article 30. Reclamation (withdrawal), temporary access to documents from registration cases, provision of registration cases and copies of documents from registration cases";
