About modification of some legal acts of Ukraine concerning enhancement of protection of the rights to configuration of semiconductor products

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Civil code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356):

The paragraph the ninth to state 1) to part one of Article 420 in the following edition:

"configuration of semiconductor products";

Shall be replaced with words 2) in the name and the text of Chapter 40 of the word of "integral chip" "semiconductor product";

"Image" and "carrier" to replace 3) in part two of Article 472 of the word respectively with words of "set of the connected images" and "carriers";

Part the second Article 475 to state 4) in the following edition:

"2. Effective period of exclusive property rights of intellectual property on configuration of semiconductor product expires in ten years which are counted from the earliest of the following dates:

the terminations of calendar year in which configuration was for the first time used on commercial basis somewhere in the world;

the terminations of calendar year in which properly drawn up application for state registration was submitted".

2. In the Law of Ukraine "About protection of the rights on topography of integral chips" (Sheets of the Verkhovna Rada of Ukraine, 1998, No. 8, Art. 28 with subsequent changes):

The name, preamble and Article 1 to state 1) in the following edition:

"About protection of the rights to configuration of semiconductor products

This Law governs the relations arising in connection with acquisition of rights and implementation of the rights to configuration of semiconductor products in Ukraine.

Article 1. Determination of terms

1. In this Law the stated below terms are used in such value:

1) the author - physical person which intellectual, creative activity creates configuration;
