About modification of some legal acts of Ukraine concerning stimulation of investing activities in Ukraine

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

To add 1) with Article 89-1 of the following content:

"Article 89-1. Features of acquisition of right and realization of the right of direct trust to the parcels of land

1. The incorporated trustee of the parcel of land has the rights and fulfills duties of the owner of the parcel of land taking into account the features provided by this Article and the Civil code of Ukraine.

2. From the date of acquisition of right by person of the right of direct trust to the parcel of land pass all rights and obligations of the owner of the parcel of land according to current agreements of lease, emphyteusis, superficies to the incorporated trustee, with agreements on establishment of land easement.

The incorporated trustee of the parcel of land, if it is provided by the agreement under which the direct trust is established, can give the parcel of land to use to the third parties only on the lease right with such features:

the lease term of the earth stops from the moment of the address of collection on the parcel of land;

the lessee cannot perform construction, mining on the parcel of land or to perform improvements which cannot be separated the parcel of land without damnification.

If it is provided by the agreement under which the direct trust is established, the incorporated trustee has the right to sign agreements on establishment of land easements. The term of such servitudes stops from the moment of the address of collection on the parcel of land.

3. The incorporated trustee has no right without approval of the founder of direct trust:

perform separation, consolidation of the parcels of land;

coordinate the documentation on land management;

initiate question concerning change of purpose of the parcel of land;

alienate the parcel of land according to the procedure of the redemption for social needs.
