About modification of some legislative acts of Ukraine concerning harmonization of the legislation in the field of comparative advertizing with the right of the European Union

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. Parts the first and seventh article 33 of the Economic code of Ukraine (2003, 144) to state sheets of the Verkhovna Rada of Ukraine to Art. No. No. 18-22, in the following edition:

"1. Unauthorized use of goodwill of the subject of managing are recognized: unauthorized use of others designations, promotional materials, packagings; unauthorized use of goods of other producer; copying of appearance of product of other producer; comparative advertizing if in such advertizing are violated requirements of the legislation of Ukraine about advertizing, about protection against unfair competition or such advertizing it is possible to qualify as unfair entrepreneurial practice";

"7. Advertizing which contains comparison with other faces, goods (activities) of other person is comparative, directly or indirectly identifies the competitor or the goods or services offered by the competitor. Comparison is not recognized illegal advertizing in cases, stipulated by the legislation Ukraine".

2. Part the sixth article 16 of the Law of Ukraine "About protection of the rights to signs for goods and services" (Sheets of the Verkhovna Rada of Ukraine, 1994, No. 7, Art. 36; 2003, No. 35, Art. 271; 2008, 23, the Art. 217) to add No. with the paragraph the eighth the following content:

"use of sign in comparative advertizing which is performed according to the legislation on advertizing, on protection against unfair competition and does not belong to dishonest entrepreneurial practice".

3. In article 7 of the Law of Ukraine "About protection against unfair competition" (Sheets of the Verkhovna Rada of Ukraine, 1996, No. 36, the Art. 164):
