About modification of part one of the Civil code of the Russian Federation

Article 1

Bring in part one of the Civil code of the Russian Federation (The Russian Federation Code, 1994, No. 32, Art. 3301; 2005, No. 1, Art. 43; 2012, No. 53, Art. 7627; 2018, No. 22, Art. 3040) following changes:

Item 6 of Article 8.1 to add 1) with the paragraph of the following content:

"The acquirer of real estate relying in case of its acquisition on data of the state register is recognized fair (Article 234 and 302) until it is judicially proved that he knew or shall know about lack of the right to alienation of this property at person from whom send it the rights to it.";

2) Article 223 to add with Item 3 following of content:

"3. The fair acquirer of premises, 302 of this Code are refused satisfaction of the claim to which based on item 4 of Article, is recognized the owner of premises from the moment of state registration of its property right. In that case the property right of the fair acquirer can be disputed judicially and premises 302 of this Code only upon the demand of person which is not the subject of the civil law specified in Item 1 of Article 124 of this Code can be requested at it according to Items 1 and 2 of Article.";

3) in Article 234:

a) the paragraph one of Item 1 after words "real estate" to add with words "if others term and conditions of acquisition are not provided by this Article,";

b) state item 4 in the following edition:

"4. The current of term of acquisitive prescription concerning the things which are at person whose of ownership they could be requested according to Articles 301 and 305 of this Code begins from the date of receipt of thing in open ownership of the fair acquirer and if the property right of the fair acquirer of immovable thing which he owns openly was registered, - no later than the moment of state registration of the property right of such acquirer.";
