About modification of some legal acts of Ukraine concerning accomplishment of military duty and passing of military service

The Verkhovna Rada of Ukraine decides:

І. Make changes to the following laws of Ukraine:

1. In the Charter of internal service of the Armed Forces of Ukraine approved by the Law of Ukraine "About the Charter of internal service of the Armed Forces of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1999., No. 22-23, of Art. 194 with subsequent changes):

1) in the Section "Introduction":

in part one of the word "shelf and it" shall be replaced with words "crews (the shelf, the ship 1 and 2 of rank, detached battalion) and it";

the fourth to state part in the following edition:

"Operation of the Charter extends to the military personnel of Service of foreign intelligence of Ukraine, the Security Service of Ukraine, Public service of special communication and information security of Ukraine, National guard of Ukraine, the State Border Service of Ukraine, the Public special service of transport, Management of the state protection of Ukraine formed according to the laws Ukraine of other military forming, bodies of special purpose with law-enforcement functions";

add with part five of the following content:

"Provisions of the Charter extend to persons liable for call-up and reservists during passing of charges by them";

The word "foreman" shall be replaced with words 2) in the third offer of Article 7 "the chief sergeant";

Article 10 to state 3) in the following edition:

"10. Each serviceman has military rank according to the Law of Ukraine "About conscription and military service". Military ranks are subdivided on army and ship according to part two of article 5 of the Law of Ukraine "About conscription and military service";

Shall be replaced with words 4) in part two of Article 24 of the word of Armed Forces of Ukraine "in the Armed Forces of Ukraine";

Article 32 to state 5) in the following edition:

"32. On the military ranks chiefs are:

military personnel of sergeant and foreman structure - for the military personnel of ordinary structure of one with them military unit;

military personnel of younger officers - for the military personnel of younger sergeant and foreman structure of one with them military unit and the military personnel of ordinary structure;

majors, captains 3 ranks, lieutenant colonels, captains 2 ranks - for the military personnel of ordinary, younger and senior sergeant and foreman structure;

colonels, captains of 1 rank, major generals, rear admirals, lieutenant generals, vice admirals - for the military personnel of ordinary, sergeant and foreman structure and younger officers;

colonel generals, admirals, generals of Ukraine - for the military personnel of ordinary, sergeant and foreman structure, younger and senior officers";

6) the first offer of part three of article 33 after the words "Services of Law and Order" to add with the words "administrative punishment in the form of arrest with content on guardroom, and content in rooms for temporarily detained Services of law and order";

7) in Article 39:

in part two of the word "The First Mechanized Regiment" shall be replaced with words "The first mechanized crew", and shall be replaced with words the words "Commander of Regiment" "The commander of crew";

in part three of the word "division of regiment" shall be replaced with words "division of crew";

To state part one of Article 41 in the following edition:

"41. The military personnel of officers, military personnel of sergeant and foreman structure appointed to positions of the chief sergeant (the chief foreman) of crew who are new appointed in military unit (the shelf, the ship of 1 rank), battalion, the chief sergeant of company, are represented to the commander of military unit and his deputies, and after the direction to divisions - to the commander of division and its deputies";

9) in Article 50:

in word part two to "Ensign Moroz", "The sir (lady) to the ensign" to exclude;

third to state part in such edition:

"Address cadets of military schools which have no military ranks of sergeant and foreman structure "Cadet Stadnikov", "the sir (lady) the cadet";

Article 53 to add 10) with part three of the following content:

"During the address to the Minister of Defence of Ukraine and his deputies who are civilians the serviceman calls their positions, adding the word "Mister (Madam)" before the job title;

11) in Article 57 of the word "ensigns and warrant officers, the faces of younger, senior and highest officers which are in inventory and in resignation" shall be replaced with words "persons discharged from military service";

Article 58 part one after the words "moral and psychological condition" to add 12) with the words "preserving life and strengthening of health";

13) in part one of Article 64 of the word and figure of "regiment (the ship 1 and 2 of rank, detached battalion)" shall be replaced with words also in figures "crews (the shelf, the ship 1 and 2 of rank, detached battalion)";

The name of Section 3 to state 14) in the following edition:

"Section 3. Obligations of officials, military personnel of ordinary structure";

The name of the subsection "Commander of Regiment (Ship 1 and 2 of Rank, Detached Battalion)" to state 15) in the following edition:

"Commander of crew (regiment, ship 1 and 2 of rank, detached battalion)";

16) in Article 66:

state part one in such edition:

"66. The commander of crew (regiment, the ship 1 and 2 of rank, detached battalion) * in peace and wartime is responsible for combat and mobilization readiness, completeness with staff, successful accomplishment by crew (regiment, the rank ship 1 and 2, detached battalion) of fighting tasks; combat training, education, military discipline, moral and psychological condition, preserving life and strengthening of health of staff; internal procedure; condition and safety of weapon, ammunition, military and other equipment, fuel and other appliances; condition of financial economy; comprehensive providing crew, condition of fire and ecological safety";

in part two and the note "*" to Article of the word "commander of regiment" shall be replaced with words "the commander of crew";

17) in Article 67:

to state the paragraph of the sixth in the following edition:

"timely to take measures for accomplishment of tasks of social and psychological ensuring combat training and professional activity of the military personnel, organization of events of moral and psychological providing";

word in paragraph ten of "new replenishment" shall be replaced with words "the replenishment which arrived to crew", and to exclude the word "new";

in the paragraph the twelfth "qualities and moral and psychological condition of each officer, ensign (warrant officer) and foreman of division" shall be replaced with words words "and moral and psychological qualities of each serviceman of officers of crew, the chief sergeant of crew and the chief sergeants of divisions, to company inclusive";

after the paragraph of the fourteenth to add with the new paragraph of the following content:

"know condition of completeness of divisions of crew and take measures to increase in its level, organize effective and rational office use of the prepared staff which arrives on completing of crew".

With respect thereto the fifteenth and thirty fourth to consider paragraphs respectively paragraphs the sixteenth and thirty fifth;

the eighteenth to state the paragraph in the following edition:

"manage legal education of the military personnel of crew, in case of making by the serviceman of criminal offense immediately to report about its making to body of pre-judicial investigation";

in the paragraph the nineteenth the words "criminal or corruption offenses and extraordinary events" shall be replaced with words "events, criminal offenses, administrative corruption and military administrative offenses";

in the paragraph twenty third shall be replaced with words words of "every period of training" "academic year (the training period)";

in the paragraph the twenty fifth to exclude the words "and also content of arrested on guardroom";

thirty third to state the paragraph in the following edition:

"organize providing conditions of the military personnel of service, preparation, life and rest, favorable for health; respect for sanitary standards and rules, accomplishment by the military personnel of rules of personal and collective hygiene to care about health of subordinates, to take all necessary measures for their physical strengthening, the prevention and prevention of injury rate and occupational diseases";

in the text of Article to replace the word "regiment" in all cases with the word "crew" in the corresponding case;

"Chief sergeant (chief foreman) of crew (regiment, ship 1 and 2 of rank, detached battalion)

67-1. The chief sergeant (the chief foreman) of crew (regiment, the ship 1 and 2 of rank, detached battalion) (further - the chief sergeant of crew) in peace and wartime is responsible for provision to the commander of crew of information and offers on passing of military service by the military personnel of sergeant (foreman) structure, level of individual preparation and moral and psychological condition of ordinary and sergeant (foreman) structure in divisions, the organization for sergeant (foreman) vertical of timely and effective implementation of the tasks determined by the commander of crew, informing and coordination of activities of the chief sergeants of divisions and unity of sergeant (foreman) structure of crew.

The chief sergeant of crew submits to the commander of crew and is the direct chief for the military personnel of ordinary, sergeant (foreman) structure of crew. He is the chief adviser of the commander of crew for all questions which concern ordinary and sergeant (foreman) structure.

67-2. The chief sergeant of crew shall:

participate in work on maintenance of divisions of crew in combat readiness;

know fundamentals of tactics of actions of crew in different types of fight, main types of arms and military equipment of crew;

it is permanent to support the high level of professional knowledge, skills, to work on their enhancement, to be sample for staff of crew on execution of service duties;

take part in planning, the organization and holding actions for combat training of crew and actions for professional development of sergeant (foreman) structure, to perform monitoring of efficiency of training of ordinary and sergeant (foreman) structure, to control observance of requirements of regulating documents for combat training and standards of preparation by sergeant (foreman) structure;

participate in holding control classes in combat training with the military personnel of ordinary, sergeant (foreman) structure of crew, report on the commander of crew on the revealed shortcomings of training of the military personnel of ordinary, sergeant (foreman) structure, provide offers on their elimination;

coordinate activities of the chief sergeants of battalions (divisions) and separate companies (batteries) of crew, give them practical help, instruct and edify, require effective fulfillment of the obligations assigned to them;

coordinate work of sergeants (foremen) of the headquarters of crew, provide offers and recommendations to heads of structural divisions of the headquarters of crew in the part concerning ordinary and sergeant (foreman) structure;

report on the commander of crew on violations of regulations, standards and provisions of the regulating documents regulating passing of military service by the military personnel of ordinary and sergeant (foreman) structure, their education and training, comprehensive providing and social protection, to provide offers on their elimination, to perform monitoring of moral and psychological condition of the military personnel;

take part in study of drafts of orders of the commander of crew on the questions which are within its competence;

according to the decision of the commander of crew to accompany it in operating time in divisions of crew, conducting check of condition of implementation of actions for combat training, participations in actions of the international military cooperation and meetings with the public;

exercise control of observance by the military personnel of ordinary, sergeant (foreman) structure of military discipline, accomplishment corrected them wearing military uniform of clothes, to check accomplishment of daily routine in divisions of crew, service by daily details;

know military rank, surname, name and middle name of the chief sergeants of battalions (divisions) and separate companies (batteries) of divisions of crew, birth date, religion, business and moral and psychological qualities, hobbies, occupation to military service, marital status, progress and shortcomings of service;

be respectful to subordinates, not degrade their honor and advantage, to put question of requirements satisfaction of the military personnel of ordinary, sergeant (foreman) structure before the commander of crew;

work on unity of sergeant (foreman) collective of crew, perform monitoring of compliance of sergeants (foremen) to standards of preparation and to provisions of the Code of the sergeant of the Armed Forces of Ukraine, to bring up respect of the military personnel of sergeant (foreman) structure of crew for their belonging to the professional sergeant case of the Armed Forces of Ukraine;

carry out individual and educational work with the chief sergeants of battalions (divisions) and separate companies (batteries) of divisions of crew;

organize carrying out charges of the military personnel of ordinary, sergeant (foreman) structure of crew, carrying out tenders and competitions;

participate in the organization of collection, the analysis and generalization of the experience got by staff during execution of tasks to destination, to bring it to the military personnel of sergeant (foreman) structure of crew;

to periodically hold working meetings with the chief sergeants of battalions (divisions) and separate companies (batteries), to perform their informing on all activities, to lead up orders (directives, orders) administrative board, to carry out monthly summing up with the military personnel of sergeant (foreman) structure of crew concerning combat training, condition of service of troops and military discipline;

organize work of Council of sergeants of crew, participate in its meetings personally, provide implementation of the made decisions;

provide to the commander of crew of the offer on encouragement or attraction to disciplinary responsibility of the military personnel of sergeant (foreman) structure of crew;

organize provision to commanders of divisions and the commander of crew of offers concerning the direction of the military personnel of sergeant (foreman) structure on training courses (including on those that are carried out abroad) and appointment them to positions;

take part in carrying out annual estimation and certification of the military personnel of sergeant (foreman) structure of crew.

The chief sergeant of crew for accomplishment of the tasks assigned to it shall know certain places of dislocation of crew, organizational and regular structure, fighting and numerical structure of divisions, moral and psychological qualities of staff, influence of socio-political situation around dislocation of crew on combat readiness of the military personnel of ordinary and sergeant (foreman) structure, degree of readiness of divisions of crew for accomplishment of tasks to destination";

19) in the name of the subsection "Chief of Staff of Regiment (Detached Battalion)" of the word of "regiment (detached battalion)" shall be replaced with words "crews (the shelf, detached battalion)";

20) in Article 68:

in part one of the word of "(detached battalion)", "(battalion)" to exclude;

in part two of the word of "(detached battalion)" to exclude, and shall be replaced with words the words "is his first deputy and the direct chief" "and is the direct chief";

in part three to exclude the word of "(battalion)";

in the text of Article shall be replaced with words the word "regiment" in all cases "the crew (regiment, detached battalion)" in the corresponding case;

21) in Article 69:

in paragraph one of the word of "(detached battalion)" to exclude;
