About introduction of amendments to the Resolution of Council of Ministers - the Governments of the Russian Federation of September 22, 1993 No. 941

2. Financing of the expenses connected with implementation of this resolution is performed for the account and within the budgetary appropriations provided in the federal budget to Federal Penitentiary Service.

3. Determine that provisions of the resolution of Council of Ministers - the Governments of the Russian Federation of September 22, 1993 No. 941 "About procedure for calculation of length of service, appointments and pension payments, compensations and benefits to persons passing military service as officers, ensigns, warrant officers and the military personnel of extra urgent service or under the contract as soldiers, sailors, sergeants and foremen or service in law-enforcement bodies, Federal fire service of the Public fire service, organizations and bodies of criminal executive system, troops of national guard of the Russian Federation and their families in the Russian Federation" (in edition of this resolution) are applied to the legal relationship which arose since August 1, 2018, except for the paragraph of the third Item 2, of provision of which (in edition of this resolution) are applied to the legal relationship which arose from the date of entry into force of this resolution.

Changes which are made to the Resolution of Council of Ministers - the Governments of the Russian Federation of September 22, 1993 No. 941

1. The fourteenth Item 1 to add the paragraph with words ", the divisions performing medical and sanitary providing the convicts and persons who are held in custody".

2. Add with Item 1 (4) the following content:

"1(4). In length of service for award of pension to faces of the private and the commanding structure of organizations and bodies of criminal executive system, dismissed from service since August 1, 2018, in addition to the periods specified in Item 1 of this resolution are set off in calendar calculation:

the period of suspension by the employee of criminal executive system of service in criminal executive system according to part 1 of article 37 of the Federal Law "About service in criminal executive system of the Russian Federation and about introduction of amendments to the Law of the Russian Federation "About the organizations and bodies performing criminal penalties in the form of imprisonment";

period of substitution by the citizen of the state positions of the Russian Federation;

the period of substitution by the citizen of positions in bodies and the organizations of prosecutor's office of the Russian Federation and bodies and organizations of prosecutor's office of USSR on which assignment of class ranks is provided;

the period of substitution by the citizen of positions in customs authorities of the Russian Federation, investigating bodies and organizations of the Investigative Committee of the Russian Federation on which assignment of special ranks is provided;

period of work as the judge;

the period of posting of the employee of criminal executive system to federal body of the government, other state body or the organization according to article 32 of the Federal Law "About service in criminal executive system of the Russian Federation and about introduction of amendments to the Law of the Russian Federation "About the organizations and bodies performing criminal penalties in the form of imprisonment";

testing term in case of arrival of the citizen on service in criminal executive system.".

3. To add Item 2 after paragraph two with the paragraph of the following content:

"In length of service for award of pension to faces of the private and the commanding structure of organizations and bodies of criminal executive system according to the Item "and" of part one of article 13 of the Law to set off time (no more than five years) of their training before revenues to service in full-time in the organizations performing educational activities for the main educational programs of secondary professional education (except for programs of training of skilled workers, employees) or the higher education (except for programs of training of research and educational personnel in postgraduate study, programs of internship, programs of assistantship training), on condition of successful passing of State Final Examination by them according to the specified programs and obtaining by its results of the education document and about qualification of the established sample, estimated at the rate of two months of training in one month of service, - concerning employees of criminal executive system, arrived on service since August 1, 2018".

4. In Item 3:

a) add the subitem "v" with the paragraph of the following content:

"the periods of service in criminal executive system in the region of the Far North equated to them areas and other areas with adverse climatic or ecological conditions including remote, according to appendix No. 2.1 (Section I) - since August 1, 2018;";

b) add the subitem "g" with paragraphs of the following content:

5. Paragraph two of the subitem "b" of Item 9 after words of "The Minister of Justice of the Russian Federation" to add with the words "Directors of the Federal Penitentiary Service".

6. To state the note 2 to appendix No. 1 to the specified resolution in the following edition:

"2. According to this list to faces of the private and the commanding structure of law-enforcement bodies in length of service for award of pension the service till December 31, 2011 inclusive, to faces of the private and the commanding structure of Federal fire service of the Public fire service - till May 22, 2016 inclusive, and to faces of the private and the commanding structure of organizations and bodies of criminal executive system - till July 31, 2018 inclusive on favorable terms is set off.".

7. In appendix No. 2.1 to the specified resolution:

a) to add the name after words of "Federal fire service of the Public fire service" with words ", organizations and bodies of criminal executive system";

b) the note after words "Federal fire service of the Public fire service," to add with words "organizations and bodies of criminal executive system,".
