Article 18 to add 1) with part three of the following content:

"In case of approval according to the Federal Law "About Insolvency (Bankruptcy)" of the plan participations of the Bank of Russia in implementation of measures for the prevention of bankruptcy of bank the Board of directors has the right to make the decision on guaranteeing going concern of such bank during the term of implementation of the specified plan.";

Article 3

1) in Article 184.3-3:

b) state item 4 in the following edition:

"4. In case of impossibility of accomplishment of the plan of participation of regulatory authority in implementation of measures for the prevention of bankruptcy of insurance company, including as a result of failure to carry out of the specified plan by insurance company, the Board of directors of the Bank of Russia makes the decision on cancellation of the specified plan. In this case the regulatory authority cancels the decisions made according to Item 8 of article 184.1-3 of this Federal Law.";

c) add with Items 13 and 14 of the following content:

"13. Measures for the prevention of bankruptcy of insurance company with participation of regulatory authority are recognized performed in case of elimination of the reasons which were the basis for decision making about approval of the plan of participation of regulatory authority in implementation of measures for the prevention of bankruptcy of insurance company, and accomplishment of the actions provided by the corresponding plan and directed to implementation of measures for the prevention of bankruptcy of insurance company. In this case the Board of directors of the Bank of Russia makes the decision on cancellation of the plan of participation of regulatory authority in implementation of measures for the prevention of bankruptcy of insurance company.

14. The stocks (share in the authorized capital) of insurance company owned by the Bank of Russia on which the decision on cancellation of the plan of participation of regulatory authority in implementation of measures for the prevention of bankruptcy is made can be implemented by regulatory authority after date of the termination of the corresponding plan according to the procedure, the stipulated in Article 184.15 presents of the Federal Law.";
