About modification and amendments in the Code of the Republic of Armenia about administrative offenses

Article 1. To state article 287 of the Code of the Republic of Armenia about administrative offenses of December 6, 1985 (further - the Code) in the following edition:

"Article 287. Procedure for protest (appeal) for the decision on administrative offense

1. The decision on administrative offense made by the body performing production on administrative offense can be protested (is appealed) administratively, established by this Code, or judicially, established by the Code of administrative legal proceedings of the Republic of Armenia, except as specified, provided by part 2 of this Article. The administrative act cannot be protested (is appealed) administratively if the same administrative act was disputed judicially and if the protest (claim) given against the administrative act is accepted to production before contest of the administrative act judicially, in that case the production initiated by administrative authority is subject to the termination.

2. Administrative acts on cases on the administrative offenses established by Articles 123, 123.1, 123.3, 123.4, 123.5 (except for the offenses provided by parts 8, of 9, 14 and 15), 123.6, 123.7, 124-124.4, 124.6, 125, of 12, of 128, 129.2, 131, of 132, of the 135.2 and 140 of this Code can be disputed judicially only after protest (appeal) administratively.

3. The decision is protested appealed) administratively in the administrative authority which adopted the administrative act in administrative authority, higher concerning administrative authority, or in the cases provided by the law - in other competent administrative authority.

If the decision on the case of administrative offense according to the procedure, stipulated in Clause 283 of this Code, is handed by e-mail, then this decision can be also appealed by the same e-mail with the electronic notification on receipt of the claim.".
