Article 15.44. Illegal production of precious metals and (or) gemstones or the subsequent making of transactions with illegally the extracted precious metals and (or) gemstones

1. Illegal production of precious metals and (or) gemstones -

attracts imposing of administrative penalty on citizens in the amount of polutorakratny to the double size of cost of the precious metals and (or) gemstones which were subject of administrative offense with confiscation of the tool of making of administrative offense or without that; on individual entrepreneurs - from triple to the quadruple size of cost of the precious metals and (or) gemstones which were subject of administrative offense with confiscation of the tool of making of administrative offense or without that; on legal entities - from quadruple to the fivefold size of cost of the precious metals and (or) gemstones which were subject of administrative offense with confiscation of the tool of making of administrative offense or without that.

2. Sale illegally the extracted precious metals and (or) gemstones in any kind, condition if such action does not contain signs of penal act, -

attracts imposing of administrative penalty on citizens in the amount of single to the polutorakratny size of cost of the precious metals and (or) gemstones which were subject of administrative offense; on individual entrepreneurs - from double to the triple size of cost of the precious metals and (or) gemstones which were subject of administrative offense; on legal entities - from triple to the quadruple size of cost of the precious metals and (or) gemstones which were subject of administrative offense.

3. Movement (including transportation or transfer) or storage is illegal the extracted precious metals and (or) gemstones in any kind, condition if such actions do not contain signs of penal act, -

attracts imposing of administrative penalty on citizens in the amount of one second to the single size cost of the precious metals and (or) gemstones which were subject of administrative offense; on individual entrepreneurs - from polutorakratny to the double size of cost of the precious metals and (or) gemstones which were subject of administrative offense; on legal entities - from double to the triple size of cost of the precious metals and (or) gemstones which were subject of administrative offense.

Article 15.45. Illegal refining of precious metals or the subsequent making of transactions with illegally the affined precious metals

1. Implementation of activities for purification of the extracted precious metals of impurity and the accompanying chemical elements with bringing content of precious metal to the values established by the legislation of the Russian Federation or exceeding their (refining), the legal entities who are not included in the list approved by the Government of the Russian Federation, individual entrepreneurs or citizens -

attracts imposing of administrative penalty on citizens in the amount of one second to the polutorakratny size cost of the precious metals which were subject of administrative offense with their confiscation; on individual entrepreneurs - from double to the triple size of cost of the precious metals which were subject of administrative offense with their confiscation; on legal entities - from triple to the quadruple size of cost of the precious metals which were subject of administrative offense with their confiscation.

2. Sale illegally the affined precious metals -

attracts imposing of administrative penalty on citizens at the rate from hundred fifty thousand to hundred eighty thousand rubles with confiscation of subject of administrative offense; on individual entrepreneurs - from hundred eighty thousand to two hundred ten thousand rubles with confiscation of subject of administrative offense; on legal entities - from two hundred ten thousand to two hundred forty thousand rubles with confiscation of subject of administrative offense.

3. Movement (including transportation or transfer) or storage is illegal the affined precious metals -

attracts imposing of administrative penalty on citizens at the rate from hundred fifty thousand to hundred eighty thousand rubles with confiscation of subject of administrative offense; on individual entrepreneurs - from two hundred thousand to two hundred thirty thousand rubles with confiscation of subject of administrative offense; on legal entities - from two hundred fifty thousand to two hundred eighty thousand rubles with confiscation of subject of administrative offense.

Article 15.46. Violation of mandatory requirements in case of the address of precious metals, gemstones and products from them

1. The actions which are expressed in transition of the property right and other property rights to precious metals, gemstones and products from them, including their use as pledge, with violation of the mandatory requirements established by the legislation -

attract imposing of administrative penalty on citizens at the rate from eighty thousand to hundred thousand rubles; on individual entrepreneurs - from hundred twenty thousand to hundred forty thousand rubles; on legal entities - from hundred sixty thousand to hundred eighty thousand rubles.

2. Violation of the mandatory requirements established by the legislation in transit precious metals, gemstones and products from them -

attracts imposing of administrative penalty on individual entrepreneurs at the rate from fifty thousand to seventy thousand rubles; on legal entities - from seventy thousand to hundred thousand rubles.

Article 15.47. Violation of mandatory requirements to accounting and storage of precious metals, gemstones and products from them, to submission of the reporting or carrying out inventory count

1. Abuse of regulations of accounting of precious metals, gemstones and products from them, non-presentation of the reporting under the forms of movement of precious metals and gemstones established by the legislation in any kind, condition or submission of the reporting containing false information on the actual consumption of precious metals and gemstones -

attracts imposing of administrative penalty on officials at the rate from twenty thousand to fifty thousand rubles; on individual entrepreneurs - from thirty thousand to sixty thousand rubles; on legal entities - from fifty thousand to eighty thousand rubles.

2. Abuse of regulations of storage and inventory count of precious metals, gemstones and products from them -

attracts imposing of administrative penalty on officials at the rate from forty thousand to seventy thousand rubles; on individual entrepreneurs - from fifty thousand to eighty thousand rubles; on legal entities - from eighty thousand to hundred thousand rubles.";

4) Article 19.14 to recognize invalid;
