Based on Item 1 of the resolution of Council of Ministers of the Republic of Belarus of July 25, 2011 No. 994 "About provision to the Ministry of Transport and Communications of powers on acceptance of regulatory legal act" and subitem 5.9 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985, the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Bring in the resolution of the Ministry of Transport and Communications of the Republic of Belarus of August 25, 2011 No. 50 "About approval of the Instruction about procedure for participation in traffic of heavyweight and (or) large-size vehicles" the following changes:

1.1. state preamble in the following edition:

"Based on Item 1 of the resolution of Council of Ministers of the Republic of Belarus of July 25, 2011 No. 994 "About provision to the Ministry of Transport and Communications of powers on acceptance of regulatory legal act" and subitem 5.9 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985, the Ministry of Transport and Communications of the Republic of Belarus DECIDES:";

1.2. in Item 1:

"enclosed" to exclude the word;

add Item with the word "(is applied)";

1.3. To be reworded as follows the instruction about procedure for participation in traffic of heavyweight and (or) large-size vehicles approved by this resolution it (is applied).

2. This resolution becomes effective since January 1, 2020.

The instruction about procedure for participation in traffic of heavyweight and (or) large-size vehicles

1. This Instruction determines procedure for participation in traffic of heavyweight and (or) large-size vehicles (further - TKTS) in case of their driving through highways public (further - highways), and also in need of their driving through streets of settlements on which there passes TKTS traffic route.

2. For the purposes of this Instruction the terms and their determinations established in appendix 1 to the Presidential decree of the Republic of Belarus of June 19, 2019 No. 239 "About journey of heavyweight and (or) large-size vehicles" and Item 2 of the Traffic regulations approved by the Presidential decree of the Republic of Belarus of November 28, 2005 No. 551, and also the following terms and their determinations are used:

the cover car - the car equipped with the flashing indicator of orange color, allocated by the owner (user) of TKTS for maintenance, having gages of dimensions of vehicles and road constructions, and also devices of operative communication with the accompanied vehicles;

the maintenance car - the car of the State automobile inspection of the Ministry of Internal Affairs (further - GAI) having special tsvetografichesky coloring and (or) the light and sound alarm system, used for maintenance;

maintenance - complex of actions for safety of traffic when driving TKTS through traffic route with use of the car of cover or the car of maintenance;

the authorized organization - the state organization authorized according to the legislation on ministerial procedures to issue special permission to driving of heavyweight and (or) large-size vehicles through highways public of the Republic of Belarus (further - special permission).

3. Driving of TKTS through highways is allowed in case of transportation of goods which cannot be divided into parts without excessive costs or spoil of these loads, according to appendix 1 and in the presence of special permission with indication of the traffic route issued by authorized organization for form according to appendix 2, except as specified, specified in subitem 1.10 of Item 1 of the Presidential decree of the Republic of Belarus of June 19, 2019 to No. 239.

Receipt of special permission is performed according to Item 5.21 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156.

4. The original of special permission on paper or its copy certified by authorized organization are at the driver of TKTS, except as specified, specified in subitems 1.10 and 1.11 of Item 1 of the Presidential decree of the Republic of Belarus of June 19, 2019 to No. 239. At the same time in case of registration of special permission in electronic form the driver of TKTS has data on number and the date of receipt of special permission.

5. Categories of vehicles for which journey in case of intra republican motor transportation of loads with exceeding of admissible weight parameters issue of reusable special permissions is allowed and conditions of issue of such permissions are established by parts two and third subitem 1.6 of Item 1 of the Presidential decree of the Republic of Belarus of June 19, 2019 No. 239.

Reusable special permission is issued by authorized organization for form according to appendix 3.

Cases in case of which issue of reusable special permissions for journey of the wheel tractors used in agricultural industry is allowed are established by part four of subitem 1.6 of Item 1 of the Presidential decree of the Republic of Belarus of June 19, 2019 No. 239.

6. Speed of movement of TKTS in case of its maintenance shall not exceed 50 km/h.

By authorized organization additional restrictions of the high-speed modes taking into account conditions of traffic, condition of road constructions, characteristics of load, and also requirements of the interested organizations approving TKTS traffic route can be introduced. The permitted mode of movement can have variable nature on different sites of traffic route of TKTS.

Restrictions of the high-speed mode are specified in special permission in the column "Special Traffic Conditions on Highways".

If movement of TKTS on highways out of settlements complicates its overtaking (advancing), the driver of TKTS and the driver of the car of maintenance (the cover car) hold position on the highway as it is possible more to the right, and if necessary and stop to pass the vehicles which accumulated behind them.

7. Before participation in traffic on TKTS the corresponding identification marks specified in appendix 5 to Traffic regulations are established.

For designation TKTS irrespective of time of day the flashing indicator of orange color which is located on the upper element of design of TKTS turns on. With width of the vehicle of more 3,5 of m flashing indicators of orange color in addition equip its extreme dimensions on width.

8. Driving of large-size vehicles through road constructions (under road constructions) is performed taking into account their actual horizontal and vertical gleams.

The inventory in light over the taken load shall be at least 40 cm to the lower point of road construction in case of independent journey and at least 15 cm to the lower point of road construction in case of journey in the presence of the representative of the owner of the highway or to maintenance.

9. With participation in traffic of TKTS:

moves with the special permission, except as specified, No. specified in subitems 1.10 and 1.11 of Item 1 of the Presidential decree of the Republic of Belarus of June 19, 2019 239, with observance of the conditions determined in such permission and also without variation from the route specified in this permission;

observes the movement speed specified in part one of Item 6 of this Instruction and special permission;

does not perform movement during intensive snowfall and formation of ice, and also in case of visibility of the road less than 100 m;

moves during daylight hours in case of exceeding of admissible dimensional parameters on width, and also other weight and dimensional parameters in case of which according to Item 17 of this Instruction maintenance is required if other mode of movement is in exceptional cases not specified in special permission;

stops on specially designated parking located outside the highway;

interrupts transportation in case of the technical defect of the vehicle menacing to traffic safety.

10. With participation in traffic of TKTS on the special permission issued on numerous transportation of the same loads on the established TKTS route extent in case of each departure in special permission the consignor's mark about departure of TKTS is given. Without such mark TKTS is recognized moving without special permission.

11. Lists of sections of the highways and road constructions limited to journey of TKTS proceeding from their maximum lump established in appendix 5 to the Presidential decree of the Republic of Belarus of June 19, 2019 No. 239, are posted on the websites of owners of highways and (or) on the website of authorized organization on the global computer Internet and staticized no later than 3 working days from the date of introduction of restrictions.

12. The owner (user) of TKTS before participation in traffic checks on the websites specified in reusable special permission, availability of restrictions on sections of highways and road constructions proceeding from the maximum lump of TKTS, and takes measures to exception of traffic route of sections of the highways and road constructions limited to journey of TKTS.

13. In the period of temporary restrictions of loads of axes of vehicles in case of adverse weather climatic conditions for driving through highways action of reusable special permissions does not extend to highways (their sites) which are entering traffic route, but having restrictions of loads of axes of vehicles during this period.

Action of reusable special permissions does not extend to road constructions on which route signs "3.11 are established. 1, 3.11.2 Restriction of weight" and (or) "3.12. 1, 3.12.2 Restriction of load of axis" where weight parameters it is less, than specified in special permission.

For ensuring compliance, specified in parts one and the second this Item, the technical means functioning in the automatic mode are used.

14. For the purpose of safety of traffic, safety of highways in case of the choice of traffic route of TKTS are estimated: transport and operational condition and the bearing capability of highways, load-carrying capacity and dimensions of road constructions on the offered route, and also intensity of traffic.

In case of the choice of traffic route of TKTS the circumstances connected with accomplishment of roadwork in case of which the existing schemes of the organization of traffic considerably change (closing of lanes, movement driving into the oncoming lane, repair of engineering constructions, routes of detours of the closed sites and other circumstances) are considered.

15. TKTS traffic route whenever possible does not pass through large settlements (population of 100 thousand and more people). In case of need TKTS traffic routes whenever possible do not pass the omission TKTS through large settlements on streets with heavy traffic of transport.

16. The conclusions of owners of transport communications, means of communication and power supply networks about conditions of journey of TKTS on traffic route are necessary in the presence at least one of the following conditions:

16.1. with height of TKTS more than 4 m (in case of journey under city lines of power network and communication);

16.2. with height of TKTS more than 5 m when driving through republican highways and more 4,5 of m when driving through local highways (in case of journey under other lines of power network and communication);

16.3. when crossing route of transportation of railway tracks in one level if the TKTS weight and dimensional parameters exceed: on width - 4 m, on height - 5 m (4 m - on the electrified sites), on length - 30 m, on lump - 60 t, and also in case of journey under road constructions (on road constructions) which owners is the Belarusian railroad;

16.4. TKTS traffic route with lump:

over 60 t pass on the road constructions having class of load-carrying capacity of the maximum caterpillar load of 60 t;

over 80 t pass on the road constructions having class of load-carrying capacity of the maximum wheel load of 80 t;

over 112 t pass on the road constructions having class of load-carrying capacity of the maximum wheel load of 112 t;

16.5. lump of TKTS exceeds the size corresponding to class of load-carrying capacity of the road construction located on traffic route if the class of load-carrying capacity of road construction is lowered in the course of its operation;

16.6. lump of TKTS exceeds 100 t;

16.7. length of TKTS exceeds 30 m;

16.8. width of TKTS exceeds 5 m;

16.9. height of TKTS exceeds 5 m (for republican highways) or if inventory in light over the taken load less than 40 cm to the lower point of road construction, and also with height of TKTS of more 4,5 of m (for local highways);

16:10. in case of exceeding of admissible axial mass (the amounts of axial masses) of over 50% (for receipt of reusable special permissions);

16:11. when driving through the streets of settlements entering TKTS traffic route.

17. Maintenance of TKTS is necessary in the presence at least one of the following conditions:

17.1. cover car:

with width of the vehicle of more 3,5 of m and to 4 m inclusive;

with height of vehicle more than 5 m, and also with vehicle height with load or without load when in case of journey at least under one road construction on traffic route 40 cm of inventory in light are not provided;

with length of vehicle more than 24 m and to 30 m inclusive;

with lump of vehicle more than 60 t and to 80 t inclusive;

17.2. maintenance car:

with width of vehicle more than 4 m;

with length of road train more than 30 m;

with lump of vehicle more than 80 t;

if the vehicle in case of movement partially occupies strip of approaching traffic;

in case of movement of TKTS in night-time in exceptional cases determined in special permission;

if in the course of movement there is need of holding additional actions for regulation of traffic for ensuring safe journey of TKTS.

18. In the cases specified in subitem 17.2 of Item 17 of this Instruction, the owner (user) of TKTS at least in 3 working days prior to transportation informs the relevant managements of GAI of the Departments of Internal Affairs of regional executive committees (management of GAI of Main Department of Internal Affairs of the Minsk city executive committee) on which territory there passes the transportation route on time and traffic route.

19. The car of cover is driven the driver having experience in maintenance of TKTS on the territory of the Republic of Belarus and aware of TKTS traffic route.

20. The car of maintenance or the car of cover moves so that as much as possible to ensure traffic safety proceeding from the developed situation.

The crew of the car of maintenance or the car of cover provides the procedure for movement of TKTS specified in special permission on road constructions (under road constructions).

21. The driver of TKTS before start of motion along route examines the traffic conditions specified in special permission and also approves the movement mode with crew of the car of maintenance or the car of cover.

22. In agricultural organizations the officials responsible for the organization of movement for highways of wheel tractors of these organizations with excess of admissible weight and dimensional parameters and their maintenances by cover cars (if width of the wheel tractor of more 3,5 of m and to 4 m inclusive) and the maintenance car are determined (if width of the wheel tractor more than 4 m).

Appendix 1

12. Reservoirs (reactors) for brewing, sugar and oil refineries.

13. Trams.

14. Motor ships (motor boats), airplanes.

15. Maritime containers.

16. Rail cars.

17. Driving boards.

18. Military equipment.

19. Perishable loads (the objects and substances which are exposed to spoil after certain storage duration or in case of adverse effect of temperature, humidity or other conditions of the environment) having the corresponding marking and mark in accompanying transport documents.

20. Other loads in the presence of the letter reasons of the owner (user) of TKTS confirming economic inexpediency of cargo hauling with smaller batches.
