About introduction of amendments to the Law of Ukraine "About the market of electrical energy"

The Verkhovna Rada of Ukraine decides:

1. Bring in the Law of Ukraine "About the market of electrical energy" (Sheets of the Verkhovna Rada of Ukraine, 2017, No. 27-28, of Art. 312; 2019, No. 23, Art. 89, No. 40, Art. 220) following changes:

Part the seventh Article 65 to add 1) with the paragraph the tenth such content:

"The guaranteed buyer shall direct difference between the income and expenses which arose during execution of special obligations by him, on providing covering of own expenses on accomplishment of special obligations on purchase of electrical energy on "green" rate and at the auction price or other special obligations";

2) in Article 67:

to state Item of 1 part three in the following edition:

"1) to producers (except the micro, mini-, small hydroelectric power stations and power plants making electrical energy from alternative energy sources) and to importers - the limiting lower bound of obligatory monthly sales amount of electrical energy in the market "for the days ahead", but no more than 30 percent of their monthly sales volume of electrical energy according to rules of the market";

include part the eighth the following content:

"8. Sale and/or delivery of the electrical energy imported from the Russian Federation according to bilateral agreements and in the intra daily market is forbidden.

For the purpose of avoidance of emergency situation in the integrated power system of Ukraine the Cabinet of Ministers of Ukraine has the right to lift the ban established by paragraph one of this part, having determined the term of renewal of action of such prohibition";

3) in the Section XVII "Final and transitional provisions":

a) to add Item 1 after the paragraph of the twenty fourth with two new paragraphs of such content:

"Temporarily, till December 31, 2020, the Regulator has powers to limit available handling capacity which is distributed at daily and monthly auctions, regarding interstate bonds between Ukraine and the states which are not members of Energy Community.
