About licensing of separate types of activity

This Law determines the legal basis of licensing of separate types of activity, and also regulates the legal relationship arising in connection with its implementation in the territory of Turkmenistan.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) the license – special permission to the implementation according to the Civil code of Turkmenistan of the licensed type of business activity and activities in the field of rendering professional services issued to the licensee by the licensing body in case of obligatory observance of licensed requirements and conditions;

2) the licensed type of activity – separate type of activity which implementation in the territory of Turkmenistan requires receipt of the license according to this Law;

3) subspecies of the separate licensed type of activity – the certain type of activity which is subject to licensing specified at the 6th level – in six-digit category (on the 1st, 2nd, 3rd, 4th, 5th and 6th code sign) according to the State qualifier of types of economic activity as a part of the licensed type of activity;

4) licensed requirements and conditions – set of the requirements and conditions established by the legislation of Turkmenistan obligatory for execution by the licensee (license applicant) in case of

implementation of the licensed type of activity, at the same time these requirements and conditions shall belong to subspecies of the licensed type of activity directly;

5) the licensee – the physical person or legal entity which obtained the license;

6) the license applicant – the physical person or legal entity which filed in the licensing body petition for licensing, for entering of amendment into the license;
