of November 4, 1992 No. 539

About the mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan

For the purpose of purposeful support of the republic national groups which are most needing social protection in the conditions of recession of economy and the continuing inflation the Government of the Republic Kyrgyzstan decides:

1. Approve the mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan developed by the Ministry of Labour and Social Protection, the Ministry of Economics and finance of the Republic Kyrgyzstan and the Federation Council of labor unions of Kyrgyzstan it (is applied).

2. Approve priority actions on address social protection of the population in the Republic Kyrgyzstan for 1992-1993 (are applied).

3. To the Ministry of Labour and Social Protection, Gosstatagentstva under the Government of the Republic Kyrgyzstan and to heads of local public administrations to conduct regular examinations of level of living and the income of needy national groups, including large families, for the purpose of implementation of actions for rendering necessary social support to them.

4. To heads of local public administrations to create in the cities and areas special service on material support of lower-income strata.

5. To the ministries and administrative departments of the Republic Kyrgyzstan together with heads of public administrations and the Federation Council of labor unions of Kyrgyzstan to prepare and submit drafts of the laws, other regulations and documents following from this resolution for consideration of the Government.

6. To impose control of realization of the mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan on the Ministry of Labour and Social Protection of the Republic Kyrgyzstan, the Ministry of Economics and Republic Kyrgyzstan finance.

Mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan

The mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan includes package of measures for determination of poverty line, distribution of the population concerning it, to address social protection of the population, sources of its financing, the organization of works on realization of the mechanism of address social protection of the population.

In case of development of the mechanism it was objectively considered that now the state has no the resources sufficient for complete requirements satisfaction of all citizens at the level of consumer minimum taking into account that it is not only about cash, but also material and ware resources.

It was taken into consideration also that about 25-30 percent of all subsistence minimum as confirm long-term statistical data of inspection of household budgets of workers, employees, collective farmers, pensioners, are provided from personal subsidiary farm, work at home, occupation with individual labor activity, dividends of securities.

I. Poverty line

In the conditions of crisis of economy, inflationary tendencies and serious difficulties of the republic the poverty line is determined by subsistence minimum which provides minimum admissible degree of satisfaction only of the basic physiological and social needs of people and preserving capability of the person to productive work in this period.

In basis of determination of subsistence minimum as poverty lines for persons corresponding social демографизической groups determination of the specific sizes shall be necessary:

- energy costs (calories) providing life activity and efficiency of the person and sets of food products corresponding to them on caloric content;

- consumption of vital nonfoods, objects of sanitation and hygiene, drugs;

- obligatory money payments for life-supporting household services and transportation expenses, taxes and fees.

According to the content of goods and services stated above natural material (consumer goods basket) taking into account changes of price levels and inflation the cost of the minimum consumer budget for each social and demographic group is regularly determined: able-bodied citizens, pensioners and disabled people, pupils and students.

This cost size of the minimum consumer budget also determines poverty line.

II. Distribution of the population concerning poverty line

At the heart of distribution of the population concerning poverty line degree of his independence, labor activity and finally material wealth level shall be pledged.

The criterion for evaluation of level of the minimum welfare should be considered average per capita cash income of family, or the income of separately living person.

At the same time the analysis of social position of the population on the following groups is carried out:

- able-bodied citizens;

- pensioners and disabled people;

- citizens at dotrudosposobny age (juvenile children and teenagers, pupils, students);

- the citizens who are on care of the state.

In all specified groups individual comparison of the income of each person (family) with the changing poverty line level (living minimum) in each social and demographic group is regularly carried out. By results of comparison need and the specific amount of address social protection is determined.

III. Address social protection of the population

Need of address social protection is determined for each person (family), taking into account their social position, by results of the carried-out comparison of the actual income with size of the established poverty line (subsistence minimum) in each social and demographic group.

 

Able-bodied citizens

The minimum income (salary) of rather subsistence minimum shall be guaranteed to the able-bodied population occupied with socially useful work in all industries irrespective of patterns of ownership. The minimum wage shall make at least 50 percent of cost of the minimum consumer budget established for the able-bodied worker in present conditions. Besides, the opportunity about 25 percent of minimum wage is given to receive depending on personal labor deposit at the expense of the operating systems of allowances, surcharges and awards.

In production industries the upper limit of the salary is not limited, and in the non-productive sphere its size shall be supported at the level of average values of industries of production of goods.

The unemployment benefit is paid to the workers released during economic reform and receiving the status of the unemployed according to the procedure of social support. Its size is determined by the Law of the Republic Kyrgyzstan "About employment of the population". For the unemployed, persons in need and persons interested to work in the national economy, public service of employment performs package of measures for their employment (including on social jobs), professional orientation and retraining.

The able-bodied citizens who are not occupied in the national economy (except for by force the unemployed), have no right to the guaranteed minimum income.

 

Pensioners and disabled people

For the citizens receiving work pensions, disabled people and participants of Patriotic war, equated to them in accordance with the established procedure persons, who became disabled people as a result of participation in recovery from the accident on the Chernobyl NPP the corresponding adjustment of the sizes of the pensions received by them, taking into account changes of price levels and inflation is given.

The minimum size of pensions of pensioners and disabled people shall constitute 70-75 percent of the subsistence minimum established for them at this stage.

For part of the pensioners receiving pensions is lower than the level of the Consumer budget and not having additional incomes, the target public assistance in type of cash and natural issues, benefits for pro-life, other subsidies shall be organized in case of individual establishment of the reasons of needs.

The last principle of the target public assistance extends also to temporarily disabled citizens: the women who are on carer's leave for the juvenile child; persons, victims of natural disasters, refugees.

 

Citizens at dotrudosposobny age (juvenile children, pupils, students)

Level of material support of juvenile children, pupils, students shall not be connected with the size of the minimum consumer budget, and the amount of the means spent for these purposes needs to be correlated to republic opportunities, and also parents.

For large families additional opportunities of self-sufficiency are given. For this purpose in first-priority procedure the earth for creation of farmer and subsidiary farms, production rooms is allocated to them, the non-interest loan on housing construction is allowed. Also the target public assistance in the form of cash and natural issues taking into account variation of per capita income in family from subsistence minimum will be organized.

For students and pupils in basis of material support the social grants paid irrespective of progress trained in the amount of 30 percent of minimum wage are pledged. Besides, in addition to social grant depending on progress and type of educational institution differentiation educational grants are applied in the amount of:

- for students of higher educational institutions - from 30 to 50 percent of minimum wage;

- for students of average special educational institutions - from 20 to 40 percent of minimum wage;

- for pupils of technical training colleges - from 10 to 20 percent of minimum wage, and for provided with food - from 5 to 10 percent of minimum wage.

Besides, for students and pupils the work opportunity in nonlearning and vacation time is found and given. It is considered also that students of the highest and average educational institutions and pupils of technical training colleges in certain measure receive the natural and monetary assistance from parents and relatives. Besides, possibilities of material and financial support to students of HIGHER EDUCATION INSTITUTIONS and pupils of average special educational institutions from among orphans and without parental support, and also from needy families are found.

 

The citizens who are on care of the state

The necessary guaranteed consumption level to the citizens who are on care of the state in hospitals, other stationary medical institutions, nursing homes and disabled people, child care and other facilities is established proceeding from the size of the minimum consumer budget fixed for them taking into account certain share of really possible self-sufficiency in each case.

IV. Organization of works on address social protection

Implementation of the mechanism of address social protection of the population needs legal support. Are for this purpose necessary:

1. Development and adoption of the Laws of the Republic Kyrgyzstan "About the minimum consumer budget", "About minimum wage".

2. Entering of corresponding changes into the Laws of the Republic Kyrgyzstan "About pensions", "About employment of the population", "About public welfare payments to the families having children".

It is required by the fact that during economic reform and development of market structures new groups of socially unprotected segments of the population appear:

- large families, whose comprehensive per capita income is below the poverty line;

- persons which for the first time are looking for work - graduates of comprehensive schools, the highest and average special educational institutions, pupils of technical training colleges;

- the persons who lost entitlement to benefit on unemployment and are not employed;

- persons receiving social pensions in view of absence at them necessary years of service for receipt of work pension.

3. Development and approval at the republican level for each social and demographic national group:

- standard rates of the energy costs necessary for preserving normal physiological state of the person and recovery of its working capacity;

- the consumer goods basket including:

standard set of food products corresponding on caloric content to energy costs of the person;

standard set of vital nonfoods;

standard set of vital objects of sanitation and hygiene, drugs;

standard list of obligatory money payments for life-supporting household services and transportation expenses;

standard list of obligatory taxes and fees.

On the basis of the above-stated standard rates methodical recommendations about calculations of the minimum consumer budget (subsistence minimum) for each social and demographic group are developed and affirm.

On the basis of republican standard social standard rates and recommendations the corresponding regional indicators can be determined and be accepted taking into account local features.

For determination of the actual minimum consumer budget by Gosstatagentstv under the Government of the Republic Kyrgyzstan systematic observation of price level of the goods and services which are part of consumer goods basket in retail, cooperative and market trade is made.

Bodies Gosstatagentstva under the Government of the Republic Kyrgyzstan systematically inspect in the city and rural zone of all regions household budgets of different social national groups all segments of the population of profession were completely provided to them (agricultural industry, independently busy peasants are not farmers, employees, income sources (the income of the farmer, the income not of the farmer, pension, social support) taking into account condition and development of market economy.

In practical work on realization of the mechanism of social protection of the most vulnerable national groups it is necessary to coordinate more purposefully both on republican, and at the local level activities of state bodies, non-governmental (public) organizations more effectively to use their potential opportunities (organizational, professional, financial, on bonds with the foreign organizations). From state bodies non-governmental organizations need to give help in preparation and advanced training of personnel, and also to facilitate their taxation.

In the cities and areas where the main practical work on realization of the mechanism of social protection of the population will be concentrated, there is no service organizing and coordinating carrying out all package of measures for material support of lower-income strata today. Therefore it is necessary to create it in case of heads of local public administrations.

In case of development of actions for implementation of address social protection studying of public opinion on efficiency of the measures taken in the republic at all levels in this area is carried out.

V. Financing of address social protection of the population

Realization of the mechanism of address social protection of the population requires attraction of all possible sources of financing. Among them: republican budget, local budgets, trust funds.

Means of these funds for social protection of the population are used in the following main directions.

The republican budget is used for regulation, in connection with inflationary tendencies of the salary of employees of the organizations and organizations which are on budget financing, professional training and retraining of personnel; holding resettlement actions; provision of pensions of the military personnel; contents of citizens; allowance payments on children are more senior than 1,5 of years: children of the military personnel of conscription service and to lonely mothers; social and educational grants to students of the highest and average educational institutions; pupil of technical training colleges; material and financial support of separate categories of students; other social groups; one-time and periodical compensation payments to separate segments of the population.

Local budgets at the level of the corresponding territories, taking into account development of the market relations are used for the organization of social jobs; allowance payments to large families; on the children who are under guardianship (guardianship) and also whose parents evade from payment of the alimony; the financial and monetary assistance to pensioners and disabled people, in case of individual determination of their income; supports of persons, victims of natural disasters; refugees; other needing citizens.

Income of the companies in the conditions of economic independence goes for wages increase of own workers, professional training and retraining of personnel including for the first time starting labor activity organized set of workers; payments for recourse actions to persons which lost fully or partially the working capacity; the additional financial and natural employee assistance (including retired) and to members of their families.

The pension fund spends the funds for payment of retirement and social pensions, child allowances aged to 1,5 of years.

The fund of employment spends the funds for allowance payment on unemployment; occupational retraining of the unemployed; partial financing of social jobs; content and development of employment services.

The Social Insurance Fund spends the funds for allowance payment to women on pregnancy and childbirth; lump-sum allowance to mothers in case of the child's birth; payment of the sick leave notes working; financing of improving actions.

Non-governmental organizations according to the Charters allocate funds for full natural and cash support poor, injured from natural disasters, render them assistance in labor employment, improvement of living conditions of N another.

The developing conditions of differentiation of the income of the population and strengthening of role of the salary as main source of the household budget predetermine need:

- coordinations of action of state bodies, companies and non-governmental organizations for the purpose of increase in efficiency of use of possibility of each of them;

- rationalization of welfare costs due to redistribution of financial sources for the purpose of ensuring the minimum level of the income of citizens and maintenance of minimum income of family.

The private sector, non-governmental organizations and the paid nature of the rendered services in this case shall play the increasing role.

The specific sizes and the directions of expenses on these purposes are determined by the laws, presidential decrees, resolutions and orders of the Government of the Republic Kyrgyzstan, orders of heads of local public administrations, other regulations, decisions of non-governmental organizations and require during the developing market relations of the corresponding amendments and amendments.

Control of realization of the mechanism of address social protection of the most vulnerable national groups of the Republic Kyrgyzstan is exercised by the Ministry of Labour and Social Protection of the Republic Kyrgyzstan, the Ministry of Economics and Republic Kyrgyzstan finance.
