Article 1. Bring in the Law of the Republic of Tajikistan "About mortgage" of March 20, 2008 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2008, No. 3, the Art. 185, No. 10, Art. 798; 2010.№7, Art. 557; 2013, No. 7, Art. 522) following changes and amendments:
1. Regarding the 2nd Article 26 of the word of "the notarial certificate of the agreement between the pledger and the pawnbroker of the address of collection" shall be replaced with words "exposure to sale of subject of mortgage extrajudicially or receipts of executive text of the notary".
2. Add with article 33 (1) the following content:
"Article 33 (1). Procedure for the address of collection on pledged property
1. The address of collection on pledged property is performed:
- extrajudicially;
- judicially, if the extrajudicial procedure for the address of collection on pledged property is not provided by the agreement on mortgage or notarially certified agreement between the pawnbroker and the pledger on satisfaction of requirements.
2. The pledger, having completely met the requirements of the pawnbroker specified in the notification provided according to part 5 of article 33 of this Law can stop the procedure of the address of collection on pledged property.".
3. State Article 34 in the following edition:
