About modification of some legal acts of Ukraine regulating questions of transplantation of anatomic materials to the person
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Paragraph one of part one of article 143 of the Criminal code of Ukraine (2001, 131) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 25-26, in such edition:
"1. Intentional violation of the procedure for application of transplantation of anatomic materials of the person established by the law which entailed essential harm to health of the victim".
2. In part three of Article 52 of Bases of the legislation of Ukraine on health care (The sheet of the Verkhovna Rada of Ukraine, 1993, No. 4, Art. 19; 2018, 28, the Art. 232) the word of "organization" shall be replaced with words No. "in organization".
3. Part the sixth article 6 of the Law of Ukraine "About burial and funeral case" (Sheets of the Verkhovna Rada of Ukraine, 2004, No. 7, Art. 47; 2018, 28, 232) to state No. to the Art. in the following edition:
"The full age capable physical person has the right to dispose concerning transfer after death of his body or anatomic materials to scientific or educational institutions, healthcare institutions. The decision on transfer of body or anatomic materials at the dead can be accepted the second of spouses or one of close relatives if it does not contradict declaration of will of the dead. The procedure for transfer of body or anatomic materials of the dead to scientific, medical or educational institutions is established by the Cabinet of Ministers of Ukraine".
4. In the Law of Ukraine "About application of transplantation of anatomic materials to the person" (Sheets of the Verkhovna Rada of Ukraine, 2018, No. 28, Art. 232 with subsequent changes):
1) in Article 1 part one:
paragraphs the sixth, the ninth, the thirteenth, fifteenth, twenty fourth to state in the following edition:
