About introduction of amendments to the Federal law "About Suspension of Action of Separate Provisions of the Budget Code of the Russian Federation and Establishment of Features of Execution of the Federal Budget in 2020"

Article 1

Bring in the Federal Law of November 12, 2019 No. 367-FZ "About suspension of action of separate provisions of the Budget code of the Russian Federation and establishment of features of execution of the federal budget in 2020" (The Russian Federation Code, 2019, No. 46, the Art. 6413) the following changes:

To add 3) with Articles 2.1 - 2.3 following of content:

"Article 2.1

1. Determine that in course of execution of the federal budget in 2020 in addition to the bases for modification of summary budget list of the federal budget established by the budget legislation of the Russian Federation, according to the procedure, established by the Government of the Russian Federation, changes in case of redistribution of budgetary appropriations on financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy, with prevention and elimination of effects of spread of koronavirusny infection and also on other purposes determined by the Government of the Russian Federation can be made to summary budget list of the federal budget without introduction of amendments to the Federal Law of December 2, 2019 No. 380-FZ "About the federal budget for 2020 and for planning period of 2021 and 2022".

2. Determine that in course of execution of the federal budget in 2020 the Government of the Russian Federation has the right to make decisions on provision of the state guarantees of the Russian Federation in currency of the Russian Federation with exceeding of the total amount of the provided guarantees established for 2020 by the Program of the state guarantees of the Russian Federation in currency of the Russian Federation for 2020 and for planning period of 2021 and 2022, and upper limit of the public internal debt of the Russian Federation on the state guarantees of the Russian Federation in currency of the Russian Federation within upper limit of the public internal debt of the Russian Federation.

3. Determine that in course of execution of the federal budget in 2020 the total amount of expenses of the federal budget can be increased without introduction of amendments to the Federal Law of December 2, 2019 No. 380-FZ "About the federal budget for 2020 and by planning period of 2021 and 2022" with the corresponding increase in budgetary appropriations of reserve fund of the Government of the Russian Federation in case and within receipt in the income of the federal budget of the income of the Central bank of the Russian Federation (Bank of Russia) from sale of ordinary shares of Sberbank of Russia public joint stock company according to the Federal Law of March 18, 2020 No. 49-FZ "About transfer of part of the income, the ordinary shares of Sberbank of Russia public joint stock company received by the Central bank of the Russian Federation from sale, and also according to the decision of the Government of the Russian Federation in case and within receipts from separate types of not oil and gas income over amounts, the income of the federal budget considered in case of approval of total amount.

4. Determine that in course of execution of the budget of the subject of the Russian Federation (local budget) in 2020 in addition to the bases for modification of summary budget list of the budget of the subject of the Russian Federation (local budget) established by the budget legislation of the Russian Federation according to decisions of the supreme executive body of the government of the subject of the Russian Federation (local administration) changes can be made to summary budget list of the budget of the subject of the Russian Federation (local budget) without introduction of amendments to the law of the subject of the Russian Federation on the budget of the subject of the Russian Federation (the municipal legal act of representative body of the municipality about the local budget):

1) in case of redistribution of budgetary appropriations on financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy, with prevention and elimination of effects of spread of koronavirusny infection and also on other purposes determined by the supreme executive body of the government of the subject of the Russian Federation (local administration);

2) in case of redistribution of budgetary appropriations between types of sources of financing of budget deficit of the subject of the Russian Federation (local budget);

3) in case of receipt of grants from other budgets of budget system of the Russian Federation.

5. Modification of summary budget list on the bases established by part 4 of this Article can be performed with exceeding of total amount of the expenses approved by the law of the subject of the Russian Federation on the budget of the subject of the Russian Federation (the municipal legal act of representative body of the municipality about the local budget).

6. Determine that following the results of budget implementation of the subject of the Russian Federation (local budget) in 2020 established by the law of the subject of the Russian Federation on the budget of the subject of the Russian Federation (the municipal legal act of representative body of the municipality about the local budget) the extent of budget deficit of the subject of the Russian Federation (local budget) and upper limit of public debt of the subject of the Russian Federation (municipal debt) can be exceeded on the amount of the budgetary appropriations aimed at financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy, with prevention and elimination of effects of spread of koronavirusny infection, the amount of decrease in tax and non-tax budget receipts of the subject of the Russian Federation (local budget) in comparison with 2019 and also in connection with change of conditions of restructuring of budget credits.

7. Determine that in 2020 budget deficit of the subject of the Russian Federation (local budget) can exceed the restrictions set by Items 2 and 3 of Article 92.1 of the Budget code of the Russian Federation for the amount of the budgetary appropriations aimed at financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy of the subject of the Russian Federation (municipality), with prevention and elimination of effects of spread of koronavirusny infection.

8. Determine that in 2020 the amount of public debt of the subject of the Russian Federation (municipal debt) can exceed the restrictions set by items 4 and the 5th Article 107 of the Budget code of the Russian Federation for the amount which is not exceeding amount of the budgetary appropriations aimed at financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy of the subject of the Russian Federation (municipality), with prevention and elimination of effects of spread of koronavirusny infection.

9. Determine that in 2020 in addition to the cases established by the budget legislation of the Russian Federation from the budget of the subject of the Russian Federation (local budget) for the decision of the supreme executive body of the government of the subject of the Russian Federation (local administration) subsidies for financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy, with prevention and elimination of effects of spread of koronavirusny infection can be provided to the legal entity, including budget and (or) autonomous institution which founder is not the appropriate subject of the Russian Federation (municipality).

10. Determine that in 2020 provision to the subject to the Russian Federation (municipality) of budget credit on replenishment of balance on the budget account is performed for the term which is not exceeding 180 days on condition of its return no later than November 25 of the current financial year.

11. Determine that in 2020 the Government of the Russian Federation has the right to make decisions on redistribution (distribution) between subjects of the Russian Federation of budgetary appropriations, the provided (increased) in federal budget for provision subventions, subsidies and other interbudget transfers to budgets of subjects of the Russian Federation, with entering of corresponding changes into the agreement on provision of subsidy (other interbudget transfer if the agreement is signed).

12. Determine that in 2020 the supreme executive body of the government of the subject of the Russian Federation has the right to make decisions on redistribution (distribution) between municipalities of budgetary appropriations, the provided (increased) in budget of the subject of the Russian Federation for provision subventions, subsidies and other interbudget transfers to local budgets, with entering of corresponding changes into the agreement on provision of subsidy (other interbudget transfer if the agreement is signed).

13. Determine that the sales amount of precious metals and gemstones from the State fund of precious metals and gemstones of the Russian Federation provided for 2020 by the Federal Law of December 2, 2019 No. 380-FZ "About the federal budget for 2020 and for planning period of 2021 and 2022" can be increased by the amount determined by the Government of the Russian Federation.

14. Determine that in 2020 the Government of the Russian Federation in case of exceeding of the basic price for oil determined according to item 4 of Article 96.6 of the Budget code of the Russian Federation, average for reporting calendar month of the level of the price of oil of the Yurals brand determined according to Item 3 of article 342 of the Tax Code of the Russian Federation having the right to use since current month resources of the national welfare fund on the purposes specified in Item 1 of Article 96.10 of the Budget code of the Russian Federation, according to the procedure, established by the Government of the Russian Federation.

15. Determine that in 2020 for the purpose of substitution of other sources of financing of federal budget deficit internal (external) borrowings, including with exceeding No. 380-FZ established by the Federal Law of December 2, 2019 "About the federal budget for 2020 and for planning period of 2021 and 2022" upper limit of the public internal (external) debt of the Russian Federation can be performed.

Article 2.2

1. Determine that the Ministry of Finance of the Russian Federation submits for review in the Commission of Federal Assembly of the Russian Federation on redistribution of budgetary appropriations in the current financial year and planning period (further - the Commission) offers on modification of summary budget list of the federal budget on the basis provided by part 1 of article 2.1 of this Federal Law, and offer on decision making according to part 11 of article 2.1 of this Federal Law. The specified offers go the Commission to the State Duma of Federal Assembly of the Russian Federation (further - the State Duma), the Federation Council of Federal Assembly of the Russian Federation (further - the Federation Council) and Audit Chamber of the Russian Federation.

2. The Commissions are included on seven representatives from the State Duma and from the Federation Council. The structure of the Commission from the State Duma affirms the resolution of the State Duma. The structure of the Commission from the Federation Council affirms the resolution of the Federation Council.

3. The commission in time no later than three working days from the date of receipt of the offers specified regarding 1 this Article makes the decision on consent to modification of summary budget list of the federal budget (redistribution (distribution) between subjects of the Russian Federation of budgetary appropriations) or on introduction of the offers specified regarding 1 this Article for consideration of the State Duma. The decision of the Commission goes to the Ministry of Finance of the Russian Federation, the State Duma, the Federation Council and Audit Chamber of the Russian Federation.

4. If the Commission within three working days did not make the decision on the offers submitted for its consideration specified regarding 1 this Article, the Government of the Russian Federation or determined according to the procedure, specified regarding 1 article 2.1 of this Federal Law, the body has the right to make the decision on entering of corresponding changes into summary budget list of the federal budget (redistribution (distribution) between subjects of the Russian Federation of budgetary appropriations).

5. In 2020 powers of representatives respectively from the State Duma and the Federation Council in the tripartite commission on questions of the interbudget relations are delegated to representatives from the State Duma and the Federation Council in the Commission.

Article 2.3

1. The government of the Russian Federation has the right:

To transfer 1) in 2020 repayment period of the obligations (debt) of subjects of the Russian Federation to the Russian Federation on the budget credits granted on preparation for holding the XXII Olympic winter Games and the XI Paralympic Winter Games of 2014 in the city of Sochi, the XXVII World summer Universiade of 2013 in the city of Kazan re-structured according to parts 9 and 10 of article 18 of the Federal Law of November 30, 2011 No. 371-FZ "About the federal budget for 2012 and for planning period of 2013 and 2014", parts 9 and 10 of article 18 of the Federal Law of December 3, 2012 No. 216-FZ "About the federal budget for 2013 and for planning period of 2014 and 2015" to actions for ensuring mitigation of consequences of drought, effects of large-scale flood in the territories of Khabarovsk Krai, the Amur region and the Jewish Autonomous Region, having provided debt repayment on principal debt and the budget credit added for the actual term of use for date of debt restructuring to percent in the period from 2025 to 2034 inclusive of annually equal shares with possibility of its early repayment;

2) to establish procedure and repayment periods of debt on principal debt and the budget credit added for the actual term of use for date of debt restructuring to percent in case of prolongation in 2020 of repayment period of the obligations (debt) of subjects of the Russian Federation to the Russian Federation on the budget credits granted to subjects of the Russian Federation for partial covering of deficits of budgets of subjects of the Russian Federation re-structured according to parts 7 and 8 of article 16 of the Federal Law of December 19, 2016 No. 415-FZ "About the federal budget for 2017 and for planning period of 2018 and 2019". At the same time the debt on principal debt and the budget credit added for the actual term of use for date of debt restructuring to percent is not subject to repayment in 2020, the debt, due for settlement in 2020, on principal debt and the budget credit added for the actual term of use for date of debt restructuring to percent is settled from 2025 to 2029 inclusive.

2. Additional payment by installments on debt repayment on budget credits is drawn up by the supplementary agreements to agreements on the provision to budgets of subjects of the Russian Federation from the federal budget of budget credits, stipulated in Item 2 parts of 1 this Article concluded by the Ministry of Finance of the Russian Federation with authorized bodies of the executive authority of subjects of the Russian Federation according to the procedure, established by the Government of the Russian Federation.

3. The budget funds of the subject of the Russian Federation released in 2020 as a result of decrease in amount of debt repayment of the subject of the Russian Federation in front of the Russian Federation on budget credits taking into account realization of the provisions provided by part of 1 this Article are subject to the direction on financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy of the subject of the Russian Federation, with prevention and elimination of effects of spread of koronavirusny infection and also compensation of decrease following the results of 2020 of tax and non-tax budget receipts of the subject of the Russian Federation in comparison with 2019.

4. The subjects of the Russian Federation who did not fulfill following the results of 2019 obligations assumed within article 16 of the Federal Law which is carried out according to parts 7 and 8 of December 19, 2016 No. 415-FZ "About the federal budget for 2017 and for planning period of 2018 and 2019" restructurings of obligations (debt) of subjects of the Russian Federation to the Russian Federation on the budget credits granted to subjects of the Russian Federation for partial covering of deficits of budgets of subjects of the Russian Federation are exempted in 2020 from early repayment of debt over the amount provided for 2020 by debt repayment schedules.";

4) in Article 3:

a) state part 1 in the following edition:

"1. Determine that till January 1, 2021 on the funds provided from the federal budget according to the decisions provided by Items 1 and 2 of part 2 and part 3 Articles 2, part 1 of article 2.1 of this Federal Law and for the means reserved as a part of the budgetary appropriations approved by the Federal Law of December 2, 2019 No. 380-FZ "About the federal budget for 2020 and for planning period of 2021 and 2022" provisions of paragraph one of Item 7, of paragraph one of Item 8 of Article 78, of Items 2 and 4 of Article 78.1 (regarding approval in the Federal Law on the federal budget of budgetary appropriations to provision of subsidies), Item 5 of Article 78 do not extend. 3, paragraph one of Item 2 of Article 79. 1, Item 2 of Article 80, Item 2 of Article 83, Item 4.1 of Article 132, the paragraph of the fourth Item 7 of Article 217 (regarding regulations on the total amount of budgetary appropriations on sources of financing of federal budget deficit) the Budget code of the Russian Federation.";

b) add with parts 1.1 - 1.3 following of content:

"1.1. Determine that till January 1, 2021 provisions of paragraph one of Item 7, of paragraph one of Item 8 of Article 78, of paragraph two of Item 2 and paragraph one of item 4 of Article 78 do not extend to the means provided from the budget of the subject of the Russian Federation (local budget) according to the decisions provided by part 4 of article 2.1 of this Federal Law. 1, paragraph two of Item 2 of Article 79.1 and Item 2 of Article 83 of the Budget code of the Russian Federation.

1.2. Determine that till January 1, 2021 provisions of Item 3 of Article 81 of the Budget code of the Russian Federation do not extend to cases of increase in reserve funds of executive bodies of the government (local administrations) according to this Federal Law.

Determine that till January 1, 2021 on payment commitments on financial provision of the actions connected with prevention of influence of deterioration in economic situation on development of industries of economy, with prevention and elimination of effects of spread of koronavirusny infection, and also other payment commitments determined by the supreme executive body of the government of the subject of the Russian Federation (local administration) do not extend provisions of the subitem 1 of Item 3 of Article 130 and Item 3 of Article 136 of the Budget code of the Russian Federation.".

Article 2

1. This Federal Law becomes effective from the date of its official publication.

2. Execution of budgets of budget system of the Russian Federation in 2020 is performed taking into account provisions of the Federal Law of November 12, 2019 No. 367-FZ "About suspension of action of separate provisions of the Budget code of the Russian Federation and establishment of features of execution of the federal budget in 2020" (in edition of this Federal Law).
