About modification of some legal acts of Ukraine concerning enhancement of legal protection of geographical instructions

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In article 160 of the Economic code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 18-22, 144):

Part the second to state 1) in the following edition:

"2. Conditions of use of geographical specifying in the field of managing are determined by the law";

Part third to exclude 2).

2. Part one of Article 502 of the Civil code of Ukraine (2003, 356) to state sheets of the Verkhovna Rada of Ukraine to Art. No. No. 40-44, in such edition:

"1. Persons of law of intellectual property on geographical specifying are producers of goods, merging of producers, other persons determined by the law".

3. In the Law of Ukraine "About protection of the rights to indication of origin of goods" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 32, the Art. 267, with subsequent changes):

The name and preamble to state 1) in the following edition:

"About legal protection of geographical instructions

This Law determines the principles of legal protection of geographical instructions in Ukraine and governs the relations arising in connection with their registration, use and protection.

Features of preparation for registration, uses and protection of geographical instructions concerning agricultural products (agricultural goods), foodstuff, wines, the flavored wine products, alcoholic drinks, and also control concerning such geographical instructions are determined by other laws";

Articles 1 and 2 to state 2) in the following edition:

"Article 1. Determination of terms

1. In this Law the stated below terms are used in such value:

1) Appeal chamber - collegiate organ of Organization for consideration of objections against decisions of Organization on acquisition of rights intellectual property items and other questions carried to its competence by this Law;
