About entering of amendments into the Code of penal procedure of the Republic of Armenia

Article 1. In Article 29 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code):

Part 1 after the words "in the protocol" to add 1) with words "(except as specified, provided by part 3.1 of article 209 of this Code)";

Part 4 after the word "circumstances" to add 2) with words "(except as specified, provided by part 3.1 of article 209 of this Code)".

Article 2. In article 209 of the Code:

The first paragraph of part 2 to add 1) with the new offer of the following content: "This procedure is not applied in the cases provided by part 3.1 of this Article.";

To add 2) with part 3.1 following of content:

"3.1. The audiovideo of testimonies of the witness is conducted, except as specified, when the participant of investigative action objects, or there are no appropriate means. In case of interrogation process audiovideo if participants of investigative action do not object, then indications, including questions and answers, are not reflected in the record of interrogation. The audiovideo is fixed on two material carriers which are applied to the record of interrogation. One of material carriers is sealed and can be opened in court, and the investigator or the prosecutor for the purpose of implementation of the procedural powers can use other carrier. The duplicate of the material carrier of audiovideo of process of interrogation is provided to participants of legal procedure during acquaintance with the criminal case file.".

Part 5 to add 3) with the new paragraph of the following content:

"In the cases provided by part 3.1 of this Article after the end of interrogation the investigator reproduces audiovideo of indications about what it is specified in the record of interrogation. The investigator or the interrogated person specifies statements of the interrogated person for audiovideo in the record of interrogation.".
