About modification of some regulations
The Parliament adopts this organic law.
Art. I. - Part (1) article 14 of the Law on the water protection zones and strips of the rivers and reservoirs No. 440/1995 (1995, No. 43, Art. 482), with subsequent changes, to add the official monitor of the Republic of Moldova with words ", the water intakes and mobile installations intended for supply of the population with water and irrigation of farmlands with the prior notice of administrative authority on water resources management.".
Art. II. - In the Law on fish fund, fishery and fish breeding No. 149/2006 (Official monitor of the Republic of Moldova, 2006, Art. No. 126-130, 597), with subsequent changes, to make the following changes:
1. Part (Article 29 to state 2) in the following edition:
"(2) Works on prevention, disinfection, improvement of specific structure, catch of fishes and repair on fishery objects are performed without water dumping, except for emergencies declared by the Commission on emergency situations of the Republic of Moldova, and cases of detection and eradication of diseases of fishes.".
2. Part (Article 38 to add 1) with Item and-1) the following content:
"and-1) dumping of water from water storage basin of complex use for the fishery technological purposes, except as specified, provided by the law;".
Art. III. - Article 110 of the Code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: 2017, Art. No. 78-84 100), with subsequent changes to add the official monitor of the Republic of Moldova with parts (3), (4) and (5) the following content:
"(3) Illegal preventing to other water users to place and/or use water intake and mobile installations according to the Law on water No. 272/2011
attracts imposing of penalty on physical persons in the amount of 40 to 60 conventional units and imposing of penalty on legal entities in the amount of 300 to 500 conventional units with deprivation or without deprivation of the right to perform certain activities for a period of 3 months till 1 year.
