About entering of amendments and changes into the Code of penal procedure of the Republic of Armenia

Article 1. To add part 1 of Article 132 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) with item 4 of the following content:

"4) the actions necessary for application of the measures of restraint provided by part Items 2-7 2 Articles 134 of this Code are executed.".

Article 2. In article 134 of the Code:

1) the first offer of part 3 to state in the following edition:

"3. Arrest can be applied only to the person accused.";

Part 4 to state 2) in the following edition:

"4. The measures of restraint provided by part 2 of this Article cannot be applied is interconnected with each other, except for subscription measure of restraint about not departure which can be applied is interconnected with the measures of restraint provided by Items 2, 4 and 5 parts 2 of this Article.".

Article 3. In article 136 of the Code:

The first paragraph of part 2 to state 2) in the following edition:

"2. Arrest is applied only by the judgment, in pre-judicial production - according to the petition of the investigator or prosecutor, and when considering the case in court - according to the petition of the party of accusation or at the initiative of court.".

Article 4. To state part 4 of article 137 of the Code in the following edition:

"4. The court rejects the petition for election of arrest as measure of restraint concerning person if it is possible to reach the purposes established by part of 1 Article 134 of this Code application of other measures of restraint to the person accused, having left the solution of question of the choice of measures of restraint of competence of the body performing production.
