About organization of some measures for emergency state in the field of public health and modification of some regulations

Proceeding from the developed epidemiological situation and importance of acceptance of timely and operational measures which are dictated by dynamics of development of the national, and also international epidemiological situation caused by spread of the COVID-19, virus considering that public concerns require taking measures, providing reaction, effective and adequate in the conditions of crisis management, in view of need of further ensuring adequate protection against disease of coronavirus of new type and recognizing important role of all involved in control and fight against COVID-19, infection

The Parliament adopts this organic law.

Art. I. - In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:

1. In Article 73:

consider single part part (1);

add Article with part (2) the following content:

"(2) in case of impossibility of accomplishment by the worker of work on the workplace organized by the employer and for the purpose of ensuring health protection and safety of the worker during the emergency situations connected with the announcement of emergency, obsidional and warlike situation or the announcement of emergency state in the field of public health, the employer taking into account specifics of work of the worker, can dispose of the motivated order (the order, the decision, the resolution) on temporary change of workplace of the worker with performance of work at home or remotely, without entering of corresponding changes into the individual employment contract. The order (the order, the decision, the resolution) is told the worker timely, including by means of electronic means.".
