About modification of some legal acts of Ukraine concerning conditions of land turnover of agricultural purpose

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

Part the sixth Article 37-1 to add 1) with the paragraph the second such content:

"Owners and users of the parcels of land of all patterns of ownership located in array of lands of agricultural purpose shall grant the servitude right for ensuring pass (drive) to other owners and users of the parcels of land to the parcels of land belonging to them on the appropriate right";

Articles 130 and 131 to state 2) in the following edition:

"Article 130. Acquisition of property right to the parcels of land of agricultural purpose

1. Can acquire the property right to the parcels of land of agricultural purpose:

a) citizens of Ukraine;

b) the legal entities of Ukraine created and registered by the legislation of Ukraine participants (shareholders, members) of which are only citizens of Ukraine and/or the state, and/or territorial communities;

c) territorial communities;

d) state.

The property right to the parcels of land of agricultural purpose can be also acquired by banks only according to the procedure of the address of collection on them as regarding pledge. Such parcels of land shall be alienated by banks at the land biddings within two years from the date of acquisition of property right.

Foreigners, stateless persons and legal entities are forbidden to acquire shares in the authorized (share) capital, the share, shares, membership in the legal entities (except as in the authorized (share) capital of banks) who are owners of lands of agricultural purpose. This paragraph voids under condition and from the date of acceptance on referendum of the decision determined by the paragraph the eighth this part.
