About entering of amendments and changes into the Law "About Protection of the Economic Competition"

Accepted by National Assembly of the Republic of Armenia on January 24, 2020

Article 1. Article 2 of the Law of November 6, 2000 No. ZR-112 "About protection of the economic competition" (further - the Law) to add with part 4.1 following of content:

"4.1. Central Bank of the Republic of Armenia can not provide in the Commission information about the provided state support.".

Article 2. To add part 1 of article 4 of the Law with the new paragraph of the following content:

"the body representing the state support - state body, and also all bodies or the organizations or officials who are authorized to provide the state support at the expense of public finance or public resources in sense of this Law.".

Article 3. In article 16.1 of the Law:

Part 1 to state 1) in the following edition:

"1. In sense of this Law the state support any support directly or indirectly provided by the body providing the state support, to business entity or certain group of business entities or for certain goods or certain sphere (including subsidy, grant, the help, the credit, the loan, property, preferences, other financial resources or other conditions) is considered under whom for business entity such benefits which the business entity would not have in case of lack of support are created, provided in the conditions of the free economic competition.";

Part 3 to state 2) in the following edition:

"3. The conclusion established by part 4 of this Article is not provided by the types of the state support directed to environment protection, mitigation of impact of climate change and adaptation to it, the problem resolution of social nature, compensation of the damage which arose owing to natural disasters or other exceptional cases, development of border communities, uniform territorial development, protection of cultural heritage, the obligation fulfillment provided by the law or the international treaty.";
