If insured person during the periods specified regarding 1 this Article had no earnings and also if the average earnings calculated for these periods in calculation for complete calendar month are lower than a minimum wage, established by the Federal Law on the date of loss occurrence, and in areas and areas in which district coefficients are in accordance with the established procedure applied to the salary, it is lower than a minimum wage, established taking into account these coefficients, average earnings proceeding from which temporary disability benefits are estimated, on pregnancy and childbirth, monthly allowance on child care, is accepted equal to the minimum wage established by the Federal Law on the date of loss occurrence, and in areas and areas in which district coefficients are in accordance with the established procedure applied to the salary, equal to the minimum wage, established taking into account these coefficients. If insured person at the time of loss occurrence works at conditions of part-time (part-time working week, part-time), average earnings proceeding from which benefits in the specified cases are estimated are determined in proportion to duration of working hours of insured person. At the same time in all cases the estimated monthly allowance on child care cannot be less minimum size of the monthly allowance on child care established by the Federal Law "About Public Welfare Payments to the Citizens Having Children".".
