About modification of some legal acts of Ukraine concerning responsibility for the crimes committed by criminal society
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):
Article 255 to state 1) in the following edition:
"Article 255. Creation, management of criminal society or criminal organization, and also participation in it
1. Creation of the criminal organization, management of such organization or its structural parts -
are punished by imprisonment for a period of seven up to twelve years with confiscation of property.
2. Participation in the criminal organization -
it is punished by imprisonment for a period of five up to twelve years with confiscation of property.
3. The actions provided by parts one or the second this Article sodeyanny the official with use of official position, -
are punished by imprisonment for a period of eight up to thirteen years with confiscation of property.
4. Creation of criminal society, that is merging of two or more criminal organizations, management of such community -
are punished by imprisonment for a period of ten up to fifteen years with confiscation of property.
5. The actions provided by parts one, the second or fourth this Article, which are commited by person which performs criminal influence or is person who is in the status of the subject of the increased criminal influence, including in the status of "code-bound criminal", -
are punished by imprisonment for a period of twelve up to fifteen years with confiscation of property.
6. Person, except the organizer or the head of the criminal organization, for crime execution, provided by part two or third this Article is exempted from criminal liability if it to the message on suspicion of making of this crime voluntarily reported to him about creation of the criminal organization or participation in it and actively promoted its disclosure.
