About modification of the Regulations on assessment, administration and use of the property (arrested) got in the criminal way approved by the Order of the Government No. 684/2018

The government DECIDES:

1. In the Regulations on assessment, administration and use of the property (arrested) got in the criminal way approved by the Order of the Government No. 684/2018 (Official monitor of the Republic of Moldova, 2018, Art. No. 384-395, 1020), to make the following changes:

1) in Item 10:

1) after words "to national currency and" to add the subitem with words "freely convertible";

in the subitem 2) of the word "convertible foreign currency" shall be replaced with words "freely convertible foreign currency";

add with subitems of 3)-5) of the following content:

"3) the electronic currency is converted into national currency or into freely convertible foreign currency by person who requests withdrawal of this currency and manages it;

4) the money withdrawn from supplier accounts of payment services is transferred into the treasurer accounts which are under authority of the Agency. In case of bank deposits they shall be transferred to treasurer accounts of the Agency after deposit term. Transfer of bank deposits is made by a court decision. The licensed commercial bank informs the Agency on money transfer into treasurer accounts;

5) after arrest of overdue receivables its cost is transferred to treasurer accounts of the Agency. Transfer is made by a court decision";

Items 12-14 to state 2) in the following edition:

"12. Use of distrained property consists in its alienation by sale at the price higher, equal or lower (according to Item 36), than the price estimated according to provisions of article 11 of the Law No. 48/2017 on the Agency on compensation of the property got in the criminal way, Articles 207-1 and 229-7 of the Code of penal procedure of the Republic of Moldova No. 122/2003 and this Provision, as follows:
