About modification of some regulations

The Parliament adopts this organic law.

St. I. - In Article 215-1 of the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:

add Article with part (3-1) following of content:

"(3-1) Measures of protection provided by Items a) - d) parts (3), are applied without fail with electronic surveillance in the procedure provided by the law.";

add Article with part (4-1) following of content:

"(4-1) Victim or, on circumstances, members of her family, having expressed the consent in writing, can carry the electronic watch system allowing to check observance of the obligation aggressor.";

part (to add 5) with the offer: "In case of application of electronic surveillance the protective instruction instantly goes also to body of probation in the location of the suspect, person accused, defendant and victim.".

St. II. - In Article 278-7 of the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes to make the following changes:

add the code with parts (2-1) and (2-2) following of content:

"(2-1) Measures of protection provided by Items a) - d) parts (2), are applied without fail with electronic surveillance in the procedure provided by the law.

(2-2) Victim or, on circumstances, members of her family, having expressed the consent in writing, can carry the electronic watch system allowing to check observance of the obligation aggressor.";

part (to state 4) in the following edition:

"(4) the Degree of jurisdiction instantly transfers the protective instruction of police, to the body of probation and other organizations or persons responsible for the law for implementation of measures of protection, for immediate execution.".
