About modification and amendments in some resolutions of the Plenum of the Supreme Court of the Republic of Uzbekistan

In the course of the judicial and legal reform, and also need of giving explanations undertaken in the country on the correct permission of the questions arising in court practice based on article 17 of the Law "About Courts" Plenum of the Supreme Court of the Republic of Uzbekistan decides:

Make changes and additions to the following resolutions of the Plenum of the Supreme Court of the Republic of Uzbekistan:

1. The resolution of the Plenum of the Supreme Court of February 3, 2006 No. 1 "About practice of appointment of criminal penalty as courts":

a) add Item 20 with the paragraph the fourth the following content:

"According to part 5 of article 60 UK in case of appointment on several sentences of corrective works or restriction on service with different size of payroll deductions or monetary pay of the convict, only terms of this punishment are subject to addition. With respect thereto, under such circumstances in case of purpose of final punishment in the form of corrective works it is necessary to specify the largest size of payroll deductions or monetary pay. By the same rules penalty when making several crimes according to the procedure of article 59 UK is imposed.";

b) add Item 30 with paragraphs second and third the following content:

"At the same time person who was earlier not serving custodial sanction needs to determine serving sentence mode type only taking into account those crimes on which custodial sanction is imposed. For example, if person is condemned for intentional heavy or especially serious crime to the punishment which is not connected with imprisonment, and for not constituting big public danger or less serious crime to custodial sanction, serving of final punishment to it shall be appointed in colony of the settlement".
