About introduction of amendments to the Law of Ukraine "About judicial system and the status of judges" concerning business trip of judges and settlement of other questions of ensuring functioning of justice system in absence period of authorized structure of the Highest qualification commission of judges of Ukraine

The Verkhovna Rada of Ukraine decides:

I. Part the second article 55 of the Law of Ukraine "About judicial system and the status of judges" (2016, 31, the Art. 545) to state sheets of the Verkhovna Rada of Ukraine to No. in the following edition:

"2. The judge's business trip in other court of the same level and specialization is performed for the term determined by the Supreme council of justice, but no more than for one year except the cases provided by the paragraph the second this part.

If the circumstances which formed the basis of business trip of the judge continue to exist, according to the address of the chairman of justices to which the judge is sent, and with the consent of such judge the Supreme council of justice prolongs business trip term, but no more than for one year. Aggregate term of business trip cannot exceed two years.

The supreme council of justice based on representation of judges of Ukraine to the Highest qualification commission can make the decision on the early end of business trip of the judge if the circumstances which formed the basis of business trip of the judge stopped what the judge is notified on.

The judge whose term of business trip expired or on whom the Supreme council of justice makes the decision on early completion of business trip of the judge returns to work to court from which it was sent. In that case determination of the new judge (board of judges) for hearing of cases which were under consideration at the judge and are not considered by it in essence, it is performed by Single judicial information and telecommunication system according to the procedure, determined by the procedural law".

II. Final and transitional provisions

1. This Law becomes effective from the date of, its publication following behind day.
