Article 1. Bring in the Procedure Code about administrative offenses of the Republic of Tajikistan of July 22, 2013 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2013, No. 7, Art. 502; 2014, No. 3, Art. 145, No. 7, h 1, Art. 391, No. 11, Art. 644; 2015, No. 3, Art. 202, No. 79, Art. 709, Art. 710, Art. 711, No. 11, Art. 956, No. 12, h 1, Art. 1109; 2016, No. 3, Art. 133, No. 7, Art. 615; 2017, No. 5, h 1, Art. 276; 2018, No. 1, Art. 8, No. 5, Art. 270, Art. 271; The Law of the Republic of Tajikistan of January 2, 2020, No. 1660) the following amendments:

1. Add Article 29 with parts 7 and 8 of the following content:

"7. In business management about administrative offenses the state lawyer has the right to participate in quality of the defender of the following persons:

- the minor orphan or the minor, parents (persons, them replacing) which are receivers of the address public assistance according to the legislation of the Republic of Tajikistan;

- persons which owing to physical or mental defects cannot independently perform the right of defense.

8. The state lawyer participates in the process on administrative offenses according to the procedure provided by this Code and the Law of the Republic of Tajikistan "About legal aid".".

2. Add with article 29 (1) the following content:

"Article 29 (1). Fee of the defender at the expense of the state

1. Fee of the lawyer participating in quality of the defender at the expense of the state is guaranteed to the following persons:

- to person which does not have opportunity to pay services of the defender who according to the legislation of the Republic of Tajikistan is receiver of the address public assistance;
