About modification of some legal acts of Ukraine concerning current of procedural terms during action of the quarantine established by the Cabinet of Ministers of Ukraine for the purpose of prevention of spread of koronavirusny disease (COVID-19)
For the purpose of enhancement of regulations of the Economic Procedure Code of Ukraine, the Code of civil procedure of Ukraine, the Code of administrative legal proceedings of Ukraine regarding current of procedural terms during action of the quarantine established by the Cabinet of Ministers of Ukraine for the purpose of prevention of spread of koronavirusny disease (COVID-19), the Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Item 4 of the Section X "Final provisions" of the Economic Procedure Code of Ukraine (2017, 48, the Art. 436) to state sheets of the Verkhovna Rada of Ukraine to No. in the following edition:
"4. During action of the quarantine established by the Cabinet of Ministers of Ukraine for the purpose of prevention of spread of koronavirusny disease (COVID-19), court according to the statement of participants of case and persons who did not take part in case if the court resolved issue of their rights, interests and (or) obligations (in case of availability at them of the right to making of the corresponding legal proceedings provided by this Code), resumes the procedural terms established by regulations of this Code if recognizes the reasons of their omission as the valid and caused restrictions implemented in connection with quarantine. The court can extend term both to, and after its termination.
The court according to the statement of person prolongs the procedural term established by court if the impossibility of making of the corresponding legal proceeding in certain time is caused by the restrictions introduced in connection with quarantine".
