About modification of the order of the Government of the Kyrgyz Republic "About questions of licensing of mineral right" of November 29, 2018 No. 561

For the purpose of enhancement of system of legal regulation in the field of subsurface use, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About questions of licensing of mineral right" of November 29, 2018 No. 561 the following changes:

1) in Regulations on the procedure for licensing of subsurface use approved by the above-stated resolution:

- to declare paragraph two of Item 2 invalid;

- in paragraph one of Item 6 of the word "for the purpose of geological search, geological exploration and development" to exclude;

- the tenth Item 14 to declare the paragraph invalid;

- declare Item 18 invalid;

- third Item 21 after the word "powers of attorney" to add the paragraph with words ", the decision on appointment of the head";

- state Item 40 in the following edition:

"40. After receipt of the license with the license agreement for designing of works the licensee constitutes and represents to the licensor the engineering design with positive expert opinions on industrial, ecological safety and protection of subsoil, except as specified, stipulated in Item 54 this provision, and also the copy of consent and/or the document on provision of the parcel of land according to the Regulations on procedure for provision of the parcels of land under subsurface use approved by the order of the Government of the Kyrgyz Republic of December 15, 2017 No. 810.

In case of mineral right on sites, border with Frontier of the Kyrgyz Republic, and in borderland permission of authorized state body in the field of protection of frontier is in addition provided.";
