About modification of the Criminal Procedure Code of Ukraine concerning implementation of criminal proceedings in Trial Court board of judges
The Verkhovna Rada of Ukraine decides:
I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) the following changes:
1. The second Article 31 to state part in the following edition:
"2. Criminal proceedings in Trial Court concerning crimes for which making custodial sanction for the term of more than ten years is prescribed are performed jointly by court as a part of three judges only according to the petition of the person accused.
Criminal proceedings concerning several persons accused are performed jointly by court as a part of three judges concerning all persons accused if at least one of them declared the petition for such consideration".
2. Add Article 315 with part four of such content:
"4. During preparatory judicial session the court explains to the person accused in crime execution for which custodial sanction for the term of more than ten years, the right to declare the petition for consideration of criminal proceedings concerning it court jointly as a part of three judges is prescribed".
II. Final and transitional provisions
1. This Law becomes effective from the date of, its publication following behind day.
2. Legal proceedings in criminal proceedings which began before entry into force of this Law and are carried out in Trial Court jointly by court as a part of three judges, proceed and come to the end with the joint structure of court determined before entry into force of this Law by the rules existing about day of its entry into force.
In criminal proceedings in Trial Court in which before entry into force of this Law the joint structure of court is determined by the rules existing before entry into force of this Law and there takes place preparatory judicial session, and legal proceedings are not appointed yet, legal proceedings in criminal proceedings are carried out and comes to the end with the structure of court provided taking into account provisions of this Law.
