About entering of amendments into the Code of penal procedure of the Republic of Armenia

Article 1. To add the code of penal procedure of the Republic of Armenia of July 1, 1998 with Articles 209.1 and 209.2 of the following content:

"Article 209.1. Features of interrogation of the witness and the victim by video conference

1. Interrogation of the witness and victim by video conference can be conducted if:

1) the witness and the victim for health reasons or to age cannot be in the body performing criminal proceedings;

2) it is necessary to ensure safety of the witness and victim;

3) conducting interrogation is impossible, or it is necessary to provide efficiency of pretrial investigation.

2. Interrogation of the witness and victim by video conference is conducted based on the order of the investigator which goes to body of pretrial investigation or inquiry in the location of the witness and victim of subjects to interrogation, according to the procedure, established by part 3 Articles of 191 of this Code.

3. Based on the order the body of pretrial investigation or inquiry in the location of the witness and victim carries out necessary legal proceedings for the purpose of ensuring conducting interrogation of the witness and the victim by video conference.

4. Interrogation of the witness and victim by video conference is conducted with observance of the rules established by Articles 206 and 208 of this Code taking into account the features stated in this Article, and in case of interrogation of the minor witness and the victim - also taking into account requirements, stipulated in Clause the 207th of this Code. Before interrogation the body of pretrial investigation or inquiry in the location of the witness and victim checks and confirms the personality of the witness and the victim, and the investigator performing proceeedings conducts interrogation. Presence of the employee of body of pretrial investigation or inquiry in the location of the witness or victim during interrogation is obligatory.
