About entering of amendments into the Code of the Republic of Armenia about administrative offenses

Article 1. To add the code of the Republic of Armenia about administrative offenses of December 6, 1985 (further - the Code) with Article 47.27 of the following content:

"Article 47.27. Violation of procedure for involuntary hospitalization

1. If within 72 hours after forced hospitalization of person having problems with mental health, executive body of the psychiatric organization the psychiatric commission it was not called:

attracts infliction of penalty in fiftyfold size of the established minimum wage.

2. Not appeal to the court of the psychiatric organization by executive body within 72 hours for forced stationary psychiatric treatment of person according to the procedure, established by the Code of civil procedure of the Republic of Armenia in case of confirmation of justification of forced hospitalization by the conclusion of the professional psychiatric commission:

attracts infliction of penalty in sixtyfold size of the established minimum wage.

3. Non-presentation by the psychiatrist performing forced hospitalization, professional written opinion on condition of person having problems with mental health, the psychiatric commission of the psychiatric organization, at least, once a month:

attracts infliction of penalty in the amount of eightyfold to the stapyatidesyatikratny size of the established minimum wage.

4. Not address executive body of the psychiatric organization in court with the requirement about cancellation of the adjudication about forced hospitalization in case of disappearance of the bases for forced treatment established by the law at person having problems with mental health before the expiration of the six-months term established by the law:

attracts infliction of penalty in the amount of eightyfold to the stapyatidesyatikratny size of the established minimum wage.

5. Repeated making of the act provided by this Article within year after application of measures of administrative punishment:
