About introduction of amendments to the Code of the Kyrgyz Republic about violations

Article 1.

Bring in the Code of the Kyrgyz Republic about violations (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2017, No. 4, the Art. 285) the following changes:

1) part 3 of Article 333 to recognize invalid;

"Article 336-1. Appeal of the court order on the case of violation

The court order on the case of violation can be appealed by the parties in appeal procedure.

Proceeedings in Appeal Court are performed by the rules provided by Chapter 44 of this Code.

By results of consideration of the claim the Appeal Court accepts one of the following decisions:

1) about leaving of the petition for appeal without satisfaction;

2) about cancellation of the court order of the first instance and about leaving of the resolution of authorized body on the case of violation without change;

3) about cancellation of the court order of the first instance and about cancellation of the resolution of authorized body on the case of violation and suit abatement about violation.

The decision by results of consideration of the petition for appeal is passed in the form of determination.

Determination of court by results of consideration of the petition for appeal takes legal effect immediately and is not subject to appeal.

The copy of determination of Appeal Court within five days is sent to party litigants about violation.".
